On 5/18/23 at 12:15 pm, Licensing Program Analyst (LPA) Chavez conducted an unannounced visit to deliver final findings for a complaint dated 4/12/23. LPA met with Regina Ceasar, Administrator, and explained the purpose of the visit.

On the allegation, “Staff show inappropriate video to clients in care,” the complainant was concerned that staff show inappropriate videos to clients or take clients to outings which caused a client to have sexual behaviors not experienced prior to go to the day program. To investigate, LPA interviewed the administrator and staff and reviewed records.

On 4/14/23 and 5/11/23, LPA interviewed the administrator. Administrator states she has instructed staff that items on their phones shouldn’t be shown to clients and says she has never witnessed staff showing anything inappropriate to clients.

She explains that movies and TV programs shown at the day program are only child-type and “Nothing violent or sexually explicit.” She says staff used to take clients to the movies prior to COVID but have not in over 3 years. Administrator says staff have been trained in new hire orientation on CALL program policies which include, “Prohibited Behavior: Sexually suggestive objects, pictures, videotapes, audio recordings, or literature placed in work areas which may embarrass or offend individuals…Engaging in any immoral, indecent, or illegal act on CALL property.” She says there was a Client #1 (C1) last year that had self-stimulation behavior and that staff would address it with the individual as it occurred as “clients are not allowed to express this type of behavior in public.”

On 4/14/23 and 5/8/23, LPA spoke with staff. Staff say they observed C1 occasionally touch the front of C1’s pants in the crotch area, C1 place C1’s hand down the front of C1’s pants, C1 place C1’s hand down the back of C1’s pants, and on one occasion staff witnessed C1 self-stimulate as staff checked on C1 in the bathroom. Staff say they redirect C1 and inform their supervisor and C1’s responsible party when they observed this behavior. Staff say they do not know of anything in the environment that would have caused C1 to have this behavior and they have not witnessed other clients with this behavior.

On 4/14/23, LPA observed clients watching a cartoon appearing to be of child-age in the large common area. There were no clients in the smaller common area room and the TV was off.

Based on evidence obtained, the allegation, “Staff show inappropriate video to clients in care,” is deemed Unsubstantiated at this time.
