On July 1, 2022 at 9:15 AM, Licensing Program Analyst (LPA) Francisco Pedroza conducted an unannounced inspection to conclude a complaint investigation. LPA met with Director Denise Juarez and advised her the purpose of the inspection. Director provided LPA a tour of the facility inside and out. There was six (6) children in care at the time of the inspection.

Allegation(s) stated that the day care dis enrolled day care child without proper notice. LPA conducted two unannounced inspections touring the facility inside and out during each inspection. During the course of the investigation, LPA conducted interviews with Director, interviews with parents, and record reviews. Director provided information that a child was dis enrolled from the facility that attended the center briefly for about seven (7) days. The facility tried working with the child using positive redirection. They spoke with child's parents to create a plan to work with their child. Unfortunately the child's behavior continued to escalate.

The chid started to physically attack other children and staff. The child spit on one of the staff. The center contacted the child's mother in the morning requesting to have the child be picked up. The facility made multiple calls to the child's mother to pick up their child, but the child's mother did not pick up their child until later in the afternoon. The facility Director made the decision to dis-enroll the child from the day care based on the child's behavior, parent's behavior, and documentation in the parent's handbook. Parent interviews confirmed that children can be dis-enrolled from the facility based on child/parent behavior. Based on LPAs observations and interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED.

No deficiencies were cited during today's inspection.

LPA conducted two unannounced inspections touring the facility inside and out during each inspection. During the course of the investigation, LPA conducted record reviews, staff, and parent interviews. LPA attempted to conduct an interview with the complainant. LPA was not able to make contact. During the staff interviews, staff denied the allegations and did not provide any evidence to colloaborate with the allegation(s).

Staff provided LPA with a day-to-day procedures on how they address children that are learning and need to be redirected. When needed staff communicate with children's parents to help develop a plan to assist with their children. Parents interviewed expressed satisfaction with the care and supervision provided by this facility and had no concerns or comments. This agency has investigated the complaint(s) alleging "staff scratched a day care child, staff pushed day care child, and staff denied entry to parent.” Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

No deficiencies were cited during today's visit.
