On 12/18/23, Licensing Program Analyst, (LPA) Francisca Velazquez conducted an unannounced inspection at the Family Child Care Home (FCCH) to deliver findings related to the above-mentioned allegation. LPA met with the Licensee, Fallon Gutierrez and explained the purpose of the inspection. LPA notes there were four (4) children present during this inspection.

The investigation included two (2) unannounced inspections, LPAs observation’s, file review and interview parents of currently and previously enrolled children. The complainant alleged Licensee is leaving daycare children unsupervised.

LPA was unable to corroborate the allegations as LPA was unable to find any evidence that Licensee is leaving daycare children unsupervised. Unannounced inspection found Licensee was always present in the home. Interviews with parents of children enrolled in the FCCH suggest the families are very happy and satisfied with the care, supervision, and services their children receive at the FCCH. CONT 9099-C

All families reported there are no concerns with the FCCH and with the care and supervision and overall expressed satisfaction with the care provided by Licensee.

Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are UNSUBSTANTIATED.

A closing interview was conducted with Licensee, Fallon Gutierrez. Licensee was provided and advised of their right to appeal (LIC 9058). A copy of this report was reviewed and provided to the Licensee.

The Notice of Site Visit (LIC 9213) was also provided to the Licensee as required by H&S Code Section 1596.817. The Notice of Site Visit must remain posted for 30 days or a civil penalty of $100.00 may apply.
