On 11/15/22, at 8:45 AM, Licensing Program Analyst (LPA) Elvin Baddley made an unannounced One Year Required Inspection of the abovementioned Family Child Care Home (FCCH). A request for a change of capacity from a Small FCCH to a Large FCCH will also be addressed during this inspection.

LPA met with Ana Rodarte, Licensee of the FCCH and explained the purpose of the inspection. The FCCH's living room, dining room, hallway bathroom and front yard are used for child care, while the backyard and remainder of the home will be excluded from child care services. Licensee informed LPA the backyard of the facility is not being used at this time and is no longer accessible to children in care as the entire area is being used for the storage of restaurant equipment. At 8:48 AM, LPA observed 6 children on site at the time of the inspection along with an assistant (cleared and associated) providing care and supervision. LPA notes four of the six children (C1, C2, C3, C4) are infants (0-24 years of age). LPA informed Licensee the maximum number of children is exceeded as four infants are on site along with two preschool aged children. LPA informed the Licensee of the ratios for Small FCCHs..

LPA observed a fireplace in family room which was screened by a glass covering. The hallway bathroom to be used for children care was observed to be clean and free of toxins. Medication and cleaning compounds in the FCCH are located in the garage. The location is inaccessible to children in care. Sharps are located atop of the kitchen refrigerator which is beyond the reach of children in care. LPA observed carbon monoxide and smoke detectors in the home. The aforementioned were tested at 9:15 AM and found to be operable. LPA observed a regulation fire extinguisher (2A10BC) on site which was purchased on the present (11/15/22). LPA reminded Licensee to purchase or have fire extinguisher serviced annually.

The FCCH's backyard is currently excluded from care. LPA observed a jacuzzi in the backyard which was empty and locked by cables. The FCCH's front yard is made up of varied footing. The front yard area is not completely enclosed. LPA informed Licensee to ensure children are directly supervised when engaged in

Based on LPA's observation, the licensee did not comply with the section cited above as six children are on site, four (C1, C2, C3, C4) of which are infants (0-24 months) which poses a potential health, safety or personal rights risk to persons in care.

activities in the front yard. LPA observed age appropriate toys and play equipment in the area.

LPA reviewed children's records. The records are current, complete and possessed emergency contact information as well as children immunizations. LIcensee has documentation memorializing child sleep checks in intervals of 15 minutes. A review of the FCCH's fire drill log show drills are current with the last occurring the present (11/15/22). The Licensee's records are also current and complete with pediatric CPR and First Aid certifications expiring on 5/18/23. The Licensee's Mandated Reporter training certification expires on 11/15/24. Licensee is reminded to renew certifications and training prior to expirations. The Licensee informed LPA no firearms or ammunition are stored on site.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an for additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA Baddley informed Licensee Ana Rodarte that this report dated 11/15/22, documents one Type B citation (See 809-D).

Capacity increase from Small FCCH to a Large FCCH is pending removal of metal grill oven on the side of the FCCH per San Luis Obispo City Fire Department Inspection of 11/14/22.

A Notice of Site visit was given and must remain posted for 30 days.
