On 10/03/2025, at 11:31 AM, Licensing Program Analyst (LPA) Shane Loftus conducted an unannounced Case Management Inspection of the abovementioned Child Care Center (CCC) as a follow up to Unusual Incident Reports (UIRs) received by the Department on 09/11/2025. LPA notes the incidents occurred on 03/31/2025, 04/23/2025, and 04/30/2025. Circumstances of the UIR involve a CCC teacher (S1) handling a child in an inappropriate manner on 03/31/2025. The UIR also alleges that on 04/02/2025, S1 forcefully moved a child’s head to get the child to sleep/rest. The incident on 04/23/2025 details S1 forcefully soothing/patting a child after a biting incident. The incident on 04/30/2025 again details S1 forcefully attempting to get a group of children to sleep/rest. LPA notes some of the names of children involved were not available.

The LPA met with Merideth Eades, Director of the CCC and explained the purpose of the inspection. The LPA, in the company of Director, toured the interior and exterior of the CCC. LPA observed seven (7) children on site during the inspection along with three (3) teachers.

Upon discussing the UIR that occurred on 03/31/2025 with the Director, LPA was informed that a teacher (S2) observed a child (C4) grab another child’s (C5) face. Another teacher, S1, then immediately responded by forcing C5 to face her while maintaining a firm grip on the child’s arm. S2 reported that after further inspection of C5’s arm, there were no visible marks. Continued on 809-C

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Upon discussing the UIR that occurred on 04/02/2025, S2 reported that during nap time, S1 used her arms to hold a child down in attempt to make them sleep or rest. S2 emailed the Director detailing what she witnessed as well as her concerns. Director informed LPA that an internal investigation would be conducted. LPA was informed that S6 would have weekly meetings with S1 and that S1 would be observed while in the classroom with children.

Upon discussing the UIR that occurred on 04/23/2025, Director informed LPA that a biting incident occurred between two children S7 and S8. Director informed LPA that S1 was upset after the incident. When the class transitioned to nap time, S2 states that she observed S1’s soothing/patting the children in an aggressive manner. S1 was put through Resource for Infant Educators (RIE) training as part of her performance improvement plan. Weekly meetings continued with S1 and management, as well as in class observations.

Upon discussing the UIR that occurred on 04/30/2025, Director informed LPA that during nap time, S3 observed S1 to be forceful with the way she was putting children to rest. S3 described that S1 uses force to turn the children’s body and heads. S3 specifically witnessed this with C9. LPA was informed that S1 was then put on administrative leave pending an investigation of the events that occurred since 03/30/2025. S1’s employment was eventually terminated as a result on 05/02/2025.

In review of the above-mentioned incidents, the CCC did not comply with the reporting requirements outlined in Title 22.

Today, a Type B deficiency is cited (refer to LIC 809-D) pursuant to Title 22 Division 12 of the California Code of Regulations. A notice of site visit was given and must remain posted for 30 days.

In addition, a written report containing the information specified..shall be submitted...within seven days..(1) Events...include...(D)Any suspected physical or psychological abuse of any child. This requirement was not met as evidenced by. Based on interview, the licensee did not comply with the section cited above in that an Unusual Incident Report was not made within the required time frame regarding suspected neglect of a child in care.
