25 | On March 13, 2025, at approximately 8:50 am, Licensing Program Analyst (LPA) Maria Olguin-Leon conducted an unannounced, case management inspection regarding lead testing for childcare centers. LPA met with teacher, Andrea Chatelain, and explained the purpose of the inspection. Present during today’s visit was teacher with 4 preschool children.
Per teacher, children bring their own water bottles from home. Facility refills water bottles from Brita water filtered pitchers. LPA observed Brita water pitchers in kitchen.
LPA discussed Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires the Lead Testing of water in the Child care Center with the teacher during the inspection. All Child Care Centers that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.
As of this date, facility has not completed lead water testing that is in accordance with the Written Directives outlined in PIN 21-21.1-CCP.
LPA referred facility representative to the Department website for lead: Toxicity Prevention and Water Testing Information.
Facility was cited for not completing lead testing during annual inspection on May 31, 2024, with a POC date of 07/31/2024. Facility is being re-cited a Type B citation for not completing lead water testing requirement prior to due date or by POC due date. A plan of correction was discussed and appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
