On 2/2/23 at approximately 3:30PM, Licensing Program Analysts (LPAs) Nathan Garcia conducted an unannounced, case management inspection for the Action Level Exceedance (ALE) of Lead in Child Care Center's water. LPA met with the Site Director, Cecilia Hinkston. The purpose of the inspection was explained.

Present in facility are 20 children, present with 4 staff members plus the director during outdoor time.

LPA discussed the new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires the Lead Testing of water in the Child Care Center with the site director during the inspection. All Child Care Centers that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.

The facility received the ALE report from the Vendor on 12/22/2022. Test results for this facility that exceeded a higher level of parts per billion (ppb) allowed, 5.5 ppb. The facility was proactive in getting facility faucets tested and putting signs indicating that the water fountain/kitchen fixture is not for drinking and or currently out of order. LPA observed the fixture was made inaccessible with signs and barricades of the button to prevent use of the fountain. According to the director, the kids bring their own water bottles and it is replenished on site from store bought filtered water and from another water source that passed the lead water testing by utilizing Brita filters, as needed. Per director, most of the food preparation does not require usage of water. If it is required, the sink that is utilized has passed the lead water testing.

LPA obtained the copies of the External Water Sampler Self-Certification Form (LIC9275), Child Care Center Sampling Checklist (LIC9276), Facility Sketch (LIC999), in an email to the LPA. LPA obtained copy of the lead water testing results as well.

No deficiencies cited today considering that the water fountain has not been used since before the pandemic in 2020. Per director, the water fountain will also be permanently removed on 2/11/23. Director will send confirmation of removal to the department.

The report and notice of site visit will be sent through email due to printer malfunction. Confirmation of receipt will be required.

This report and notice of Site visit is provided to the licensee and must remain posted for 30 days.
