On October 30th, 2024 at approximately 9AM, Licensing Program Analysts (LPAs) Tapia-Mandujano and Naves conducted an unannounced, annual inspection with a Case Management inspection. LPA met with Director, Bernadette "Berni" Pioroda Cruz and explained the purpose of the inspection. Present in the facility are Director and five staff caring for a total of 9 infant children. All adults working in the facility are fingerprint cleared and associated to the facility.

Facility has requested to increase capacity from 14 to 20 infant children. LPAs measured the indoor space to be a total of 684.48sqft (not taking out encumbered spaces) divide by 35sqft allowing up to 19 infant children. Indoor space was not set up and equipped with the designated napping area which would reduce more useable space. LPA cannot approve a capacity of 20 children with the current space and set up in the infant room.

Facility operates in (Infant) Classroom #3. The facility will operate as a combination center with infants and preschool children, Monday - Friday from 8:30 AM to 5:30 PM. LPAs and Director inspected the facility for any health and safety hazards. LPAs observed all required postings to be posted in the entryway of the facility. There is a fully charged 2A10BC fire extinguisher present outside the infant classroom. Electrical outlets were observed to be covered when not in use. The infant classroom was observed to be in orderly condition. The diaper changing station is within hands reach of the nearest sink.

The outdoor infant play area was observed to be in clean and orderly condition. The facility has a waiver to allow five infants to be present in the play area at any time. The facility was in compliance with the waiver during the visit.

LPAs reviewed five staff files and five children's files. LPAs found children's files to be complete. LPAs reminded Director of requirement to have complete immunization records on file for all staff, with MMR, Tdap and Influenza vaccines on record. Type B citation was issued. During file reviews it was discovered that there is only one fully qualified lead teacher and one qualifying aide with 9 children, making the classroom be out of ratio by one child. Type B citation was issued. Last emergency drill was conducted 09/2024. Emergency drills are conducted at least once every six months and are properly logged and documented.

Based on observation, interview, and record review, the licensee did not comply with the section cited above as there are 9 infant children with one lead teacher and one fully qualified aide. Classroom did have 3 additional staff that have no qualifying units. This poses a potential health, safety or personal rights risk to persons in care.

Facility serves food to infants in care. In the case that children bring food from home, the facility labels it and stores it in a fridge. Facility appropriately maintains children's medication in its original packaging. Children bring their own water bottles from home and staff refills the bottles as needed.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a
maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).

LPAs verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. Facility does not have any lead exceedances of 5.4ppb and is in compliance with the Written Directives.

LPAs discussed the safe sleep regulations with director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPAs also informed director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

This facility provides Incidental Medical Services – IMS. LPAs reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.
