On October 24th, 2024 at approximately 9am, Licensing Program Analyst’s (LPAs) Tapia-Mandujano and Naves conducted an unannounced 10- day complaint inspection in response to the above allegation. LPAs met with Director, Lynda Ramoul and explained the purpose of the visit. Present during inspection was Director and five other staff caring for a total of 28 preschool age children. As of today, all staff present have fingerprint clearance and are associated.

Complaint was received by the Department on 10/23/24. During today’s inspection, LPAs conducted a health and safety inspection, reviewed children’s files, interviewed Director, and received pertinent documentation. Documents that were received by LPAs were Children’s Roster, Parent Handbook, Admission Agreement, Holiday Calendar, and LIC 500: Personnel Report.

During the course of the investigation, LPAs have determined that the facility is enrolling children under 24 months operating beyond the limitations of capacity. LPAs determined that there is currently one child present who is under 24 months during today’s inspection. Based on interview conducted with Director, she has confirmed that there have been children enrolled under 24 months “from time to time”.

Based on interview and record review which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, are being cited. Please refer to 9099D for more information.

LPAs informed the Director to provide a copy of this licensing report dated October 24, 2024, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Appeals Rights were also provided.

Upon receipt of this report, Facility shall post the Notice of Site Visit. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain postings as required, will result in an immediate $100 civil penalty. This report is public and can be reviewed.

Based on observation and record review, C1 was enrolled before 24 months and is present during today’s inspection. Limitations on license specifies the youngest age for program is 24 months. This poses an immediate health, safety or personal rights risk to persons in care.

Director may submit an exception request for C1 to be enrolled at the facility but C1 cannot return until exception letter has been approved by CCLD.

Director will develop a written plan on how to prevent enrolling children underage in future.
