Licensing Program Analyst (LPA) Marie Rodriguez conducted an annual continuation inspection. LPA met with Director Sarah Jen and explained purpose of inspection. Present in the infant program are the Director, one teacher, two teacher's assistants, and 14 infants. School is operating within capacity requirements and in compliance with child to staff ratio. Hours of operation are Monday to Friday from 8:00am to 6:00pm.

Four staff records were reviewed. Staff S2 does not have the infant/toddler class units required to be a qualified infant teacher. Staff S3 and S4 have a criminal record clearance but are not associated to this license. They are associated under Empire Preschool SM license #414004883. Staff S4 has an incomplete personnel record and does not have a mandated reporter training certificate on file.

Facility representative was reminded about Mandated Reporter training available on CCLD website. Training must be completed every 2 years by all staff hired. Training can be taken online at www.mandatedreporterca.com. If training is not available in native language, a statement can be written stating exemption until the translation is available.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Deficiencies cited today under California Code of Regulations, Title 22, Division 12, which follows on LIC 809D.

LPA
informed facility representative Bonnie Li that this report dated April 27, 2023 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA informed the facility representative to provide a copy of this licensing report dated April 27, 2023 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with facility representative Bonnie Li. Appeals Rights were given.


A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
