On August 15, 2025, Licensing Program Analyst (LPA) Maria Olguin-Leon, conducted an unannounced visit to close the complaint investigation into the above allegations. LPA met with Interim Site Supervisor, Jessica Mota-Ramos and LPA explained the purpose of the inspection.

Facility is a single license that offers a toddler program and preschool program. Present during today’s visit were Interim Site Supervisor, two staff caring for 15 children (1 toddler and 14 preschoolers). LPA verified that all adults present during inspection have criminal background clearances and associated to facility.

During the course of the investigation, LPA conducted both staff and parent interviews, conducted health and safety inspections. Based on information gathered and interviews conducted throughout the investigation, the allegations of “Staff restrained a day-care child” and “Staff handles day-care children in a rough manner” has occurred. The preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED.

A type “A” violation was issued today in accordance to the California Code of Regulations, Title 22, Division 12. Please refer to 9099D for more information.

LPA Maria Olguin-Leon informed Interim Site Supervisor, Jessica Mota-Ramos, that this report dated August 15, 2025, documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Maria Olguin-Leon informed Interim Site Supervisor, Jessica Mota-Ramos, to provide a copy of this licensing report dated August 15, 2025 that documents any Type A citation to parents/guardians of all children currently enrolled, by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with Interim Site Supervisor, Jessica Mota-Ramos. Appeal rights were provided. This report is public and can be reviewed.

Facility will discuss the allegations that were substantiated and all staff will be made aware of the incidents that occurred.

LPA will refer facility to Child care Advocate for personal rights training.

Based on investigation and interviews, there were incidents observed of a child being handled in a rough manner and children were restrained and swaddled to remain in sleeping blankets. This poses an immediate health, safety and personal rights risk to children in care.

Facility will train all staff on the alternate ways to handle children to not violate the children's personal rights.

Written plan, training agenda and notes must be submitted to LPA Maria Olguin-Leon via email by August 29, 2025.

LPA verified that all adults present during inspection have criminal background clearances and associated to facility.

During the course of the investigation, LPA conducted both staff and parent interviews, conducted health and safety inspections. Based on information gathered and interviews conducted throughout the investigation, LPA determined that based on the information obtained there is not sufficient evidence to prove the allegation: Staff left day-care children in a room unattended

Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
