25 | On June 1, 2023, Licensing Program Analyst (LPA) Komal Charitra conducted an unannounced joint case management visit with Fire Inspector, Jose Andrade from the San Mateo Fire Department and John Freitas from San Mateo City Code Enforcement to follow up on a visit conducted on May 15, 2023. LPA Charitra, Inspector Andrade, and John Freitas met with Licensee/Administrator Lilia Mauricio and explained the purpose of the visit.
On 5/15/23, LPA and Inspector Andrade inspected the first floor and second-floor of the facility. According to the Fire Inspector, the first floor of the building is in compliance, however the second-floor construction that was observed requires proper building permits.
On 5/15/23, LPA Charitra assessed a civil penalty of $1,100 as a result of Licensee not providing LPA the plan of correction for section 87203 Fire Safety which was cited on 5/3/23. During the visit today, LPA received the plan of correction by the Licensee. Plan of correction has been verified and deficiency is now cleared. A civil penalty is being assessed in the amount of $100 a day from 5/16/23 through 6/1/23 and will be STOPPED as of 6/1/23. A civil penalty in the amount of $1,700 is being assessed today.
During the visit today, San Mateo Code Enforcement which is responsible in approvals of new construction joined LPA Charitra and Inspector Andrade to observe the construction on the second-floor of the building. LPA Charitra, Inspector Andrade and Code Enforcer John Freitas observed the 3 compartments/rooms that were constructed on the second-floor. Code Enforcer took photos of the constructed area and notified Licensee of requirements. Smoke alarms were present in each compartment/room as requested by the Fire Inspector.
Once San Mateo City Code Enforcement approves the second floor with the new additions, an updated fire request will be requested from San Mateo Fire Department to include the approval of the additional rooms that were built on the second-floor.
According to Code Enforcer, Licensee needs to work with San Mateo City Building Department to either legalize the second-floor rooms to be habitable sleeping areas or remove the constructed area until proper building permits are obtained and approved. According to Licensee, the facility is in contact with the Building Department and has been taking steps to obtain proper permits.
--San Mateo County Code Enforcement to send CCL and Licensee a copy of the report/letter from today's visit.
--Licensee to submit a written plan to indicate what plans are for the second-floor construction by 6/18/23.
Report is reviewed with Licensee/Administrator, Lilia Mauricio and a copy is provided. Copy of civil penalty is provided with appeal rights. |
