On this day Licensing Program Analyst (LPA), Jaime Vado, conducted an uannounced complaint investigation visit to deliver findings in the alleagation above. LPA met with the administrator Ricardo Aban and explained the purpose of this visit.

During the course of the investigation LPA conducted mulitple interviews; received and reviewed documents specific to the investigation. It is discovered that although it could not be established wether it was a diaper or a pair of pants that was put near a resident's face, it is confirmed that the action of something being put near the resident's face did occurr, and is a violation of personal rights in not treating the resident with dignity and respect. This is mutually agreed upon between the Department and the facility.

Based on LPA interviews and items letters received, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 6, are being cited on the attached LIC9099D. Report is reveiwed with the administrator.

Personal Rights of Residents in All Facilities - (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (1) To be accorded dignity in their personal relationships with staff, residents, and other persons.

Licensee shall conduct personal rights training for all staff as a reminder to show residents dignity and respect. Evidence of this training is to be received as well as the instruction materials.

This regulation has not been met as evidenced by: During interviews conducted it was determined that the action of either a diaper or a pair of pants was put near the face of a resident. Although the item could not be determined in specific, it was agreed upon that the action alone is a violation of the personal rights of the resident.

On this day Licensing Program Analyst (LPA), Jaime Vado, conducted an uannounced complaint investigation visit to deliver findings in the alleagation above. LPA met with the administrator Ricardo Aban and explained the purpose of this visit.

During the course of the investigation LPA conducted mulitple interviews; received and reviewed documents specific to the investigation. It is discovered during the course of the investigation that the item, either a diaper or a pair of pants, was put near the resident's face could not be accurately determined. In interviews conducted with the resident, the alleged item was initially described as soiled diaper. Then during another interview it was said to be a pair of pants. Due to the conflicting information received LPA could not determine the accuracy of the allegation. This allegation is unsubstantiated.

Based on these observations, the above allegations are UNSUBSTANTIATED.
Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegations are unsubstantiated at this time. Report is reveiwed with the administrator.
