25 | On November 6, 2024 Licensing Program Analyst (LPA) Susana Martinez conducted an unannounced Case-Management- Deficiencies inspection to address a staff (S1) who does not have a criminal record clearance associated to the facility. LPA advised director, Ana Schmid of the purpose for the inspection. LPA toured the facility inside and outside. At the time of inspection there were 53 children in care of 9 staff.
During the inspection LPA observed S1 to be missing from the facility personnel roster. LPA asked S1 if they go by any other names, S1 stated no. LPA asked S1 how long they have been working at the facility, S1 stated more than 2 years. LPA asked Director to provide LPA with copy of Clearance letter, Director admits a clearance letter was not found in S1's file. LPA referenced the Guardian Portal to verify status of criminal record clearance. It was determined that the application was closed in 2022 due incomplete application. Guardian generated a letter addressed to S1 on 09/09/2022, indicating action was required.
During today's inspection one (1) Type A deficiency was issued and can be found on the attached 809-D.
LPA Martinez informed Director Ana Schmid that this report dated 11/06/24 documents One Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Martinez informed the Director Ana Schmid to provide a copy of this licensing report dated 11/06/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
Exit interview conducted, appeal rights were given, and report was reviewed with director Ana Schmid.
