On 3/12/2026, Licensing Program Analyst (LPA) German Negrete made an unannounced inspection to deliver findings of the above allegations. LPA met with Beatriz Martinez Interum Director of the Child Care Center (CCC). LPA explained the purpose of the inspection. During the inspection LPA toured the facility, inside and out. LPA noted 21 children and 4 staff providing care and supervision.

The investigations included reviewing the following CCC documents: children case notes, children roster, CCC director time off summary report.The investigation also included conducting/reviewing CCC staff interviews and interviews of parents of chidlren who are currently and formerly enrolled at the CCC.

Regarding Allegation#1 Director is not present. LPA received/reviewed CCC time of summary report. For the calendar year of 2025, LPA discovered in the week of 3/15/2025, the director at the time( Jaquelyn Mcdonough), was absent from the CCC for approximately 40 hours. Continued on LIC9099-C

Through staff statements and documents, LPA discovered that a site supervisor(S#2) was the staff who covered and was in charge during the directors absence during the aforementioned week.

Through the staff interviews LPA discovered. CCC staff have observed the former director present at the CCC for about 2 to 3 days out of the week in the year of 2025. Staff interviews also revealed interim director or S#3 were present and providing guidance at the CCC when the former director was absent.

LPA conducted parent interviews of formerly, and currently enrolled children. In total there were 5 parents interviewed. Most parent stated they were not aware of who the CCC director was during the time their child attended the CCC.

Regarding Allegation#2, children constantly crying. As mentioned LPA interviewed parents. The interviews revealed most parents have not observed children crying constantly at the CCC.

LPA interviewed CCC staff. The interviews revealed, there is a policy that CCC staff need to follow when a child is constantly crying. However, when asked if there have been a recent situation where a child or children are constantly crying and cannot be consoled, CCC staff stated no. LPA also reviewed a standard of conduct agreement. The aforementioned agreement, informs staff, how they need to use positive methods when guiding a child.

Although allegation#1 and #2 may or may have occurred or are valid, there is not a preponderance of evidence to prove the violation did or did not occur. Therefore, this allegation is UNSUBSTANTIATED

Regarding allegation#3, Teacher speaks to children in a rough manner. LPA interviewed parents. Most parents interviewed stated they would recommend this FCCH. However, two parents who were interviewed reported CCC staff do yell at children.

LPA conducted staff interviews. The interviews revealed one staff member observing another staff yell at children. Also according to statements collected, the same staff member who yells at children also makes unprofessional comments to children.

LPA reviewed self-reported unusual incident (UIR) and discovered the following UIR: On 12/23/2025 C1 was displaying challenging behavior. C1 was in the bathroom being supervised by Staff#4. According to a staff statement that was attached to the report. Staff#4 grabbed C1 in a aggressive manner. The same statement also detailed how staff#3 has been observed saying offensive comments to children in care.

Furthermore, a intervention improvement plan was obtained and reviewed by LPA. The plan outlines concerns CCC management have identified regarding Staff#4's behavior. One of the areas Staff#4 needs to improve on is, guiding children with a professional calm tone. Staff#4 signed the plan on 1/21/2026. LPA notes there is already a outside agency providing supportive services to all staff regarding interactions with children in care, at the CCC.

Based on the information obtained through documents and interviews, the preponderance of evidence standard has been met. Allegation#3, Teacher speaks to children in a rough manner is substantiated.

through documents and interviews, it was discovered, the above regulation was not met as evidence by: Staff#4 utilizing unprofessional behaviour such as loud voice and offesive remarks towards children in care.
