13 | On October 10 2023, Licensing Program Analyst (LPA) Giovani Gonzalez conducted an unannounced inspection to conclude a complaint investigation. LPA met with Director Jacqueline McDonough and advised them the purpose of the inspection. At the time of the inspection there were 20 children present. The Department obtained 1 allegation that the facility was conducting unapproved construction on site while children are in care.
Interviews with Director was conducted. Director stated that they were not aware that they needed to report construction to Community Care Licensing before breaking ground. Director stated that they broke ground on September 1, 2023, and had reported it via email on September 6, 2023. During the facility tour on 9/13/2023 LPA observed that the toddler playground was under construction, however at the time of inspection it was not being worked on.
Based on LPA's interview with Director, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
Because Director informed Community Care Licensing immediately after learning they needed to report construction on 9/6/2023 no deficiency is being is being cited. A Technical Violation is being issued on the attached LIC9102.
