On 12/14/2022, at 2:00 PM, an Informal Compliance Conference was called to discuss the recent deficiencies in the operation of Family Child Care Home, (FCCH) pursuant to Title 22 Division 12 of California Code of Regulations. Present during the meeting were Licensing Program Manager (LPM) Maria Mueller, Licensing Program Analyst (LPA) Francisca Velazquez, Licensee, Pomposa Cendejas and Licensee's daughter, Noemi Zendejas. The meeting was conducted via a virtual tele-conference using zoom application.

Deficiencies:

Criminal Record Clearance 102370(d)(1) cited on 10/27/2022

Licensee’s adult child, Alfredo Cendejas Tapia resides in the garage of the FCCH and does not have criminal record clearance which poses an immediate health, safety or personal rights risk to persons in care.

Licensee did not have proof for required immunization's for Licensee and assistants in the FCCH which pose/poses a potential risk to health and safety of persons in care.

Licensee’s assistants working directly with children did not have required mandated reporter certificate available for review which pose/poses a potential risk to health and safety of persons in care.

All Type B citations were cleared by 11/03/2022. In addition, on 11/03/2022 the department received a letter from Licensee's child, Noemi Cendejas stating that she will be providing a free room to Alfredo Cendejas Tapia to reside in until the criminal record clearance is granted.

In response to these discussions, Licensee agreed to the following:

• The Licensee shall be responsible in the operation of Family Child Care Home, in compliance with the Title 22 Regulations.

• The Licensee shall ensure that the home shall be free from defects or conditions which might endanger a child.

• The Licensee shall attend in person Family Child Care Orientation on February 16, 2023 from 9:30AM - 1:30PM in San Luis Obispo's Resource and Referral office.

• Licensee shall attend a Guardian tutorial to ensure Licensee can verify all adults living or working in the FCCH have obtained criminal record clearance prior to living or working in the FCCH.

• The Licensee shall attend a training focusing on environmental safety through Smart Horizons.

• The Licensee shall attend a training focusing on documentation and record keeping and will ensure all personnel files and child files are current and up to date.

• The Licensee shall participate in the Technical Support Program (TSP) to ensure her FCCH is in compliance with Title 22 regulations.

• Increased unannounced visits to the FCCH will be made for the next 2 years as required by this compliance plan.

• Licensee was encouraged to go the Community Care Licensing home page and review the quarterly updates to the regulations at www.ccld.ca.gov.

• Licensee was informed that training videos are available on the Community Care Licensing website at www.ccld.ca.gov as well as the California Smart Horizon Childcare Website http://www.smarthorizons.org/childcareLicensee was also given a hand out on Smart Horizons.

Licensee is required to provide copies of this Office Visit Report to parents of children in care and to parents of newly enrolled children during the next 12 months and adhere to the posting requirements. The acknowledgement of Receipt (LIC 9224) shall be completed and maintained in each child's file.
