32 | Licensee agreed to comply with all the conditions for Inactive License such as she will not provide childcare for which a license is required until her license is activated, promptly pay her annual license fee, and inform CCL of any changes with the date licensee requested to place her license to Inactive prior to reopening the family childcare home by submitting a new LIC 9211.
On 11-7-2023, Licensee called Santa Barbara Regional Office and spoke to the Officer on Duty to ask about exempt care. Licensee was informed that she can only care for one family that is not related to her.
Licensee states that she took care of six (6) children from 3 different families, that are not related to her. Licensee states on November 7, 2023, was the last day she took care of the children. Today, Licensee also requested to activate her license.
Based on LPAs observation, interview with licensee, and record reviews conducted, the preponderance of evidence standard has been met, therefore, the above allegation is found to be Substantiated. Health and Safety Code H&S 1596.8535 is cited on the attached 9099 D.
Upon receipt of this report, Licensee shall post and provide copies of this licensing report to parents /guardian of children in care at the facility and to parent/guardians of children newly enrolled at the facility during the next 12 months. Licensee will provide LIC 9224 for each child in care and have each parent sign the form that they have received a copy of the report LIC 9099 and LIC 9099 D.
Today’s visit was conducted in Spanish by LPA Jimenez. This report was translated in Spanish b LPA Jimenez. Today, deficiency cited under Title 22 Division 12, Spanish Appeal rights provided to licensee.
A Notice of site visit was given to Martina Esparza, licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with licensee, Martina Esparza.
This report must be filed in the facility file and made available for public review for 3 years. LPA observed the "Notice of Site Visit" posted. Failure to post the Notice of Site Visit for 30 days may result in a $100.00 Civil Penalty.
