Licensing Program Analyst Joaquin Mendez conducted an unannounced 3 year Required Annual/Random inspection of the above-mentioned Family Child Care Home (FCCH). LPA met with Dolores Mariscal , Licensee of the FCCH and explained the purpose of the inspection. LPA, in the company of the Licensee, toured the exterior and interior of the FCCH. This a two-story home with 4 bedrooms, three bathrooms, a living room, family room, kitchen, dining area, covered patio, and backyard.

The home’s one (1) bedroom located on the first floor, living room, backyard, and first floor bathroom are used for childcare services. The family room, kitchen, dining room, and 3 bedrooms upstairs including upstairs bathrooms are not used for childcare services and is excluded from childcare. A child safety gate is placed at the base of the stairs, preventing children access to the upper floor. At the time of the inspection, seven (7)children were present with 2 Assistants (S1) and assistant (S2).

· The home’s family room has a fireplace with a metal meshing screen and glass cover, preventing child access. LPA notes fireplace is in the living room with no access to children in care.
· LPA observed multiple smoke and carbon monoxide detector combination affixed to the home’s ceiling and were tested at 4:04 PM and found to be operable.
· Required forms are predominantly posted on the wall of the FCCH's room. LPA reminded the Licensee the importance of maintaining accurate records and having documents readily available.
· The home maintains working telephone services by way of cellular phone.
  • The home was clean, orderly, and void of hazardous items.

· Medication in the home are stored in an elevated cabinet in the kitchen inaccessible to children in care.
· LPA observed cleaning compounds stored in FCCH's laundry room which was locked and inaccessible to children.
· Toys, furniture, and equipment observed in the FCCH were in satisfactory condition and age appropriate. LPA reminded the Licensee the importance of maintaining clean and safe structures for children in care.
· Knives and sharps were stored in an elevated cabinet in the kitchen and inaccessible to children.
  • The backyard is enclosed by wooden and brick fencing.

· Toys and play equipment observed in backyard were age appropriate and in satisfactory condition.

· No bodies of water were observed on site.

  • Children's records were reviewed. Records were current, complete, and possessed emergency contact information for Children in care.
  • The Licensee's records were reviewed and found to be current except as noted below.

· CPR and First Aid certifications expiring on 7/28/26.

· Mandated reporter training certificate was missing for licensee. Technical advisory cited and noted at the bottom of report. See LIC9102 Co-licensee (S1)Mandated reporter expires 7/23/25, that is required per AB 1207.

  • Licensee did not have any employee info on hand and was cited a technical advisory noted at the bottom of report. See LIC9102

· Licensee stated that there are no weapons/ammunition in the home.

· The fire extinguisher was observed mounted on the dining room wall and was purchased 02/28/2024 LPA reminded the Licensee to either service or purchase a regulation fire extinguisher annually.

· Licensee is current with immunization required per SB 792.

· The last Safety drill was conducted 06/07/2024.

Licensee, was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee, Dolores Mariscal and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

LPA also informed licensee Dolores Mariscal the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The Licensee Dolores Mariscal is not providing Incidental Medical Services (IMS). IMS policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee, Dolores Mariscal was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE, Dolores Mariscal confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was given to Licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Exit interview conducted and report was reviewed with the licensee, Dolores Mariscal . The inspection visit was conducted in Spanish as is preferred language to Licensee Dolores Mariscal and report was translated in Spanish by LPA Mendez.

During today's inspection two technical assistance citations were issued. See LIC9102 for further information. LPA observed licensee post the Notice of Site visit.

FAILURE TO POST THE NOTICE OF SITE VISIT FOR 30 DAYS MAY RESULT IN A $100.00 CIVIL PENALTY.
