32 | Also, as part of the investigation LPA conducted/completed a interview with licensee. During the interview Licensee stated, the FCCH did not follow capacity requirements on 7/22/2026. Licensee continued to state on 7/22/2026, in the afternoon hours, licensee and assistant were providing care and supervision to 17 children. Licensee further stated the incident of being out of ratio on 7/22/2026 was not on purpose, licensee was assisting a parent who needed last minute child care services due to parent's personal appointment. This last minute assistance led to licensee being out of ratio.
Additionally LPA interviewed assistant. The interview revealed assistant and licensee were providing child care services on 7/22/2026 at the FCCH to approximately 17 children. Furthermore assistant stated normally there are approximately 12 to 14 children receiving care and supervision, in the afternoon hours at the FCCH.
Based on the information obtained through documents and interviews, the preponderance of evidence standard has been met. Allegation, Facility(FCCH) operated over capacity is substantiated. The FCCH will receive a type B citation regarding title 22 CCR chapter 3, article 6, section 102416.5(a).
Exit interview was conducted with Licensee Berta Lopez. Appeal rights were provided in Spanish. Notice of site visit was issued to Licensee.
THE NOTICE OF SITE VISIT NEEDS TO BE POSTED AS REQUIRED BY H&S CODE SEC. 1596.817. THE NOTICE OF SITE VISIT MUST REMAIN POSTED FOR 30 DAYS OR A CIVIL PENALTY OF $100.00 WILL APPLY.
