Licensing Program Analyst Joaquin Mendez conducted an unannounced Annual/Random inspection of the abovementioned Family Childcare Home (FCCH). LPA met with Maria Soto, Licensee of the FCCH and explained the purpose of the inspection. LPA, in the company of the Licensee, toured the exterior and interior of the FCCH. This home consists of 3 bedrooms and 2 bathrooms, a living room, second family room converted into a daycare room, kitchen, dining area, garage, and backyard.

The home’s second living room (converted into daycare), bathroom and backyard are used for childcare services. The first living room, kitchen, dining room, bedrooms, garage are not used for childcare services and are excluded from childcare. A child safety gate is placed at the entry way of the kitchen preventing children access to the excluded areas. The garage door located in the daycare room is fixed with a safety doorknob cover making it inaccessible to children in care. At the time of the inspection, nine (9) children were present and one (1) assistant.

· LPA observed a combination smoke and carbon monoxide detector affixed to the home’s ceiling and tested at 9:16 AM and found to be operable.
· Required forms are predominantly posted on the wall of the FCCH's room. LPA reminded the Licensee the importance of maintaining accurate records and having documents readily available.
· The home maintains working telephone services by way of home and cellular phone.

The home was clean, orderly, and void of hazardous items.
· Medication in the home is stored in an elevated cabinet in the kitchen. Other medications are stored in the licensee’s bedroom.

·LPA observed cleaning compounds stored in the home’s garage which was inaccessible to children.

· Toys, furniture, and equipment observed in the FCCH were in satisfactory condition and age appropriate. LPA reminded the Licensee the importance of maintaining clean and safe structures for children in care.


· At 8:57 AM an infant was observed sleeping in a car seat. Licensee immediately removed the infant and laid infant in proper bed. A technical violation was cited at 8:57AM. A Technical Violation 9102 is attached for reference.
· At 8:59 AM LPA observed two (2) infants with safety pillows in the play pen while napping. A Technical Violation 9102 is attached for reference.

The backyard is enclosed by wooden and brick fencing and foundation is covered by artificial grass and cement.

· Toys and play equipment observed in backyard were age appropriate and in satisfactory condition. LPA advised the licensee to periodically check for insects or damaged equipment prior to children usage.

· No bodies of water were observed on site.

· Yard has two (2) gates separating by fenced locked gates and inaccessible to children. In the separated areas are tools and a shed inaccessible to FCCH.

Children’s records were reviewed. Records were current, complete, and possessed emergency contact information for Children in care. The Licensee's records are also current and complete.

· CPR and First Aid certifications expiring on 1/08/25.

· Mandated reporter training certificate expires 9/02/25, that is required per AB 1207.

· S1 was missing mandated reporter certificate. A type B deficiency is cited. The attached LIC809D can be viewed for reference.

· Licensee stated that there are no weapons/ammunition in the home.

· Licensee stated she does not hold a foster family license.

· S1 was missing records from file and A technical advisory is issued. See attached LIC9102 for reference.

· Knives are stored in a elevated cabinet in the kitchen inaccessible to children.

· The fire extinguisher was observed mounted on the dining room wall and was purchased 02/02/2024 LPA reminded the Licensee to either service or purchase a regulation fire extinguisher annually.

· Licensee is current with immunization required per SB 792.

· Fire drills last drill was conducted 1/2024. Licensee conducted the fire drill during inspection 9/4/2024 and is now current. A Technical Violation 9102 is attached for reference.

maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee, Maria Soto and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

LPA also informed licensee, the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The Licensee Maria Soto is not providing Incidental Medical Services (IMS). IMS policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/.

Licensee, Maria Soto was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE, Maria Soto confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS on 9/03/2024.

A notice of site visit was given to Licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Exit interview conducted and report was reviewed in the preferred language, Spanish with the licensee, Maria Soto.

During In today’s inspection two (2) type B deficiencies was cited. See LIC809D for reference. Three (3) technical violations and one (1) technical advisory was issued. See attached LIC9102s for reference.

LPA observed licensee post the Notice of Site visit.

FAILURE TO POST THE NOTICE OF SITE VISIT FOR 30 DAYS MAY RESULT IN A $100.00 CIVIL PENALTY.
