32 | The licensee denied the occurrence. Licensee stated child# 7 got scared of the dog's excitement -wagging tail and jumping who was following her husband going for a walk. Upon hearing the child's cry, licensee immediately checked the child and there was no bite or injuries . During parent's interview, Parents did not report any issues regarding the dog.
Regarding the allegation Licensee threatened an 11-year-old child not to disclose the incident of dog-biting, LPA Reyes attempted to interview child #3, but did not receive a call back from the parents. No witnesses confirmed the allegation. The licensee denied making any threats to C# 3. C#3 who was also present when the dog came out of the room, jumping and wagging tail (following licensee's husband to the door) told Licensee that the dog had bitten C7. Licensee immediately checked C7 and saw no injuries or bite. Licensee, wanted to reassure C3 but because of the broken English, she tried to say "No, the dog did not bite your sibling" but she said it in the way that came out as "don' tell that" which she meant "do not say that" None of the parents corroborated with the allegation.
During today's inspection, LPA Reyes interviewed C10 and C11 who stated that dogs are always in the room or in the barricaded side of the yard inaccessible to children. C10 and C11 stated that the dogs in the home had not bitten any children. LIcensee's husband, Jose Esparza was also interviewed who stated that every time he brings his dog out for a walk, they get excited, wagging tails, barking, or running. Mr. Espara also stated that he has no knowledge of any dog biting in the FCCH.
Investigation includes LPA Jimenez's two unannounced inspection, interviews with licensee, assistant, complainant, and parents of day care children.
Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the above allegations are deemed UNSUBSTANTIATED.
