On 06/23/2025, Licensing Program Analyst (LPA) Bill Billones conducted an unannounced inspection to deliver findings related to a complaint received by the Department on 03/27/2025. LPA met with Director Tanya Pacheco of the above-mentioned Child Care Center (CCC) and together toured the inside and outside of the facility. At the time of the inspection, LPA observed 5 staff providing care and supervision to 17 children.

The complaint alleged a violation of Neglect/Lack of Supervision, specifically a child (C1) had sustained injuries that the center was unable to provide cause.

The investigation consisted of three unannounced inspections. As part of the investigation, LPA conducted interviews with the director, staff, and parents of currently enrolled children. LPA reviewed relevant electronic communication between staff and parents. LPA reviewed the children’s roster, the Guardian roster, staff files, and the center’s parent handbook. Continued on 9099-C

During the investigation, one unusual incident involving C1 was reported to the Department. Witness statements revealed discrepancies in the reported incident, therefore, corroborating the allegation that a child sustained an injury while in care and the center was unable to provide cause.

Based on LPA's observations, interviews, review of documentation, and evidence gathered, the preponderance of evidence standard has been met. Therefore, the allegation of Neglect/Lack of Supervision resulting in injury is determined to be SUBSTANTIATED. As a result, one Type B deficiency is being cited today under California Code of Regulations, Title 22, Division 12 on the attached LIC 9099D. This report must be made available to the authorized representatives of children in care and maintained in the facility file for three years.

An exit interview was conducted with the Director, Tanya Pacheco. Copies of the Appeal Rights and the Notice of Site Visit (LIC 9213) were provided. The Notice of Site Visit must remain posted in a visible location for 30 consecutive days. Failure to comply with posting requirements will result in a $100.00 civil penalty.

On 06/23/2025, Licensing Program Analyst (LPA) Bill Billones conducted an unannounced inspection to deliver findings related to a complaint received by the Department on 03/27/2025. LPA met with Director Tania Pacheco of the above-mentioned Child Care Center (CCC) and together toured the inside and outside of the facility. At the time of the inspection, LPA observed 5 staff providing care and supervision to 17 children.

The complaint alleged violations of Personal Rights, specifically the allegation that there are safety concerns about classroom conditions and the allegation that there aren’t enough fans or air conditioning for the classrooms during periods of extreme weather conditions. The complaint also alleged a violation of Ratio, specifically the allegation that the teacher to child ratio was inadequate resulting in noncompliance with Title 22 Regulations. Continued on 9099-C

The investigation was initiated on 04/04/2025 by LPA Bill Billones, who conducted the first unannounced inspection. A second unannounced inspection was conducted on 06/18/2025 by LPAs Bill Billones and Elizabeth George to continue the assessment. During both inspections, LPAs toured the indoor and outdoor areas of the facility, with focused observations of the classroom conditions and the play yard. LPAs also reviewed facility documentation, including the children’s roster, Guardian system records. Interviews were conducted with the program director and a sample of parents from both current and former enrollment.

During the inspections, LPAs did not observe any visible or safety concerns regarding classroom conditions. LPAs observed Classroom 4 contained an AC unit and additional fans were available for use. Through LPA’s observations and review of staff records, facility was in compliance with ratio during each visit.

On 06/23/2025, LPA Bill Billones concluded the investigation and delivered the findings. Based on observations, interviews, and records reviewed, there was insufficient evidence to support the allegations. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations – safety concerns about classroom conditions; the center not having enough fans or air conditioning for classrooms; and the center not within staff-infant ratio are UNSUBSTANTIATED.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
