On 1/3/23, Licensing Program Analyst (LPA) Francisca Velazquez conducted an unannounced One Year Required Inspection of the Family Child Care Home (FCCH). LPA met with Nora Rodriguez Rico, Assistant of the facility and explained the purpose of the inspection. LPA notes COVID Pre-screening questions were asked prior to the inspection. Assistant’s responses suggest the FCCH is void of COVID positive cases. At the time of inspection, LPA observed three (3) children on site being cared by Assistant. Per Assistant, Licensee is out of town and unavailable for today’s inspection. Licensee was telephoned and informed of inspection.

LPA, in the company of Assistant toured the interior and exterior of the FCCH. This is a two (2) story home with four (4) bedrooms and three (3) bathrooms, two (2) living rooms, kitchen, dining area, laundry room, garage and outdoor yard. LPA observed that daycare services occur in one (1) living room and hallway, one (1) bathroom, and part of the outdoor yard. Meanwhile, one (1) master living room, garage, entire second floor and part of the outdoor yard are inaccessible to children in care. LPA explain to Assistant that Licensee must be present for 80% of the work day. Assistant reported that Licensee will return on 1/4/23 in the evening. The facility will not offer services tomorrow and will resume services on 1/5/23.

The FCCH was observed to be clean and orderly. The FCCH has ventilation to afford for the children’s comfort. The FCCH was void of hazardous items. LPA observed sharps and medication for the family are stored in elevated cabinets in the kitchen that are inaccessible to children in care. LPA observed cleaning compounds are located in the laundry room in an elevated cabinet that are inaccessible to children in care. The bathroom used for childcare is clean and free of toxins. LPA notes children pass through laundry room to have access to bathroom. Assistant reports children are always supervised. Toys, furniture, and equipment in the FCCH are age appropriate.

Required forms are predominantly posted on the entrance of the FCCH. LPA observed a smoke and carbon monoxide detectors in the FCCH. The detectors was tested at and found to be operable at 3:00 PM.

The FCCH has a regulation fire extinguisher on site with a receipt that has a date that cannot be completely identified. LPA observed fire extinguisher was purchased on the 16th day of a month in 2022. Licensee will request a new receipt with visible date. LPA reminded the Assistant to either service or purchase a regulation fire extinguisher annually. The FCCH maintains working telephone services, Assistant's cell phone.

LPA toured the exterior of the home. LPA notes that the children have their own outdoor play yard. LPA observed one (1) shed that is inaccessible to children in care. Children have access to filtered water by means of individual water cups. The outdoor yard affords plenty of shade for the children in care. Toys, furniture and equipment used in the outdoor yard is age appropriate.

Part of the yard is not accessible to children in care, LPA observed two (2) bodies of water, jacuzzi and swimming pool. LPA notes that both bodies of water are located in the outdoor yard that is not accessible to children in care. There is a tall fenced that is locked separating both yards. In addition, the swimming has fencing all around with two (2) locks making it inaccessible. LPA observed jacuzzi is covered and has four (4) locks making it inaccessible to children in care. Per Licensee, children do not have any access to this yard.

LPA reviewed children's records. The records are current, complete and possessed emergency contact information and immunization records. FCCH does not have any infant enrolled and therefore is not documenting infant 15-minute sleep. A review of the FCCH's fire drill log shows the last drill occurred during today’s inspection, 1/3/23. The Assistant records were reviewed. Assistant’s s pediatric CPR and First Aid certification expires on 12/4/2024. Assistant’s Mandated Reporter training certificate expires 7/1/23. Licensee is reminded to renew certifications and training prior to expirations. The Assistant, informed LPA no firearms or ammunition are stored on site.

Per Licensee, four (4) adults live in the home. Licensee, Licensee's two parents and Licensee's adult child. After reviewing fingerprint clearance, LPA notes Assistant is not associated to the facility however is cleared and associated to Licensee's previous facility. FCCH will submit transfer request form for Assistant. LPA notes that Licensee's mother is also not associated to the FCCH. Licensee's mother was observed on off-limits areas of the home. Per Assistant, Licensee's mother does not provided care and supervision to children. LPA reviewed DOJ clearance letter for Licensee's mother. Follow up is needed to ensure Licensee's mother is cleared and associated to the FCCH. CONt 809-C

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an for additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

During today’s inspection, no deficiency observed.

A Notice of Site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Assistant, Nora Rodirguez Rico in Spanish due to Spanish being Assistant’s primary language.
