Licensing Program Analysts (LPAs) Martina Jimenez and Shane Loftus, conducted an unannounced Plan of Correction for the Inspection conducted on 6/17/2024 and met with Maribel Aguilar, Licensee, Pablo Villa-Garcia, assistant. The purpose of the visit was discussed.

LPAs together with the licensee toured the home inside and out. LPAs observed three (3) infants and eight (8) children present, during the inspection.

LPAs observed on the living floor a bag Miracle-Gro potting mix accessible to children in care. The licensee stated licensee's minor child was going to pot a plant in the front yard the night before leaving the bag of potting mix on the living room floor accessible to children in care.

LPAs also observed one pac-N-play and one crib located in the living room. The licensee stated that one infant does not sleep and if the infant does sleep the licensee will lay a mat on the floor for the infant to sleep on because licensee only has the two napping equipment mentioned above.

The following deficiencies cited during a case management inspection on 6/17/2024 has been cleared:
102417(g)(1) The home shall contain a fire extinguisher and smoke detector device which meet standards established by the State Fire Marshall.
102425(j)(2)(B) The provider shall check and document the following: Signs of distress which includes but is not limited to flushed skin color, increase in body temperature and restlessness.

102423(a)(2) (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment.

Today’s inspection was conducted in Spanish by LPA Jimenez. This report was translated in Spanish by LPA Jimenez. Spanish Appeal rights provided to licensee. Licensee was provided the Acknowledgement of Receipt (LIC 9224). Parents shall receive a copy of LIC809, LIC8099C, and LIC809D. Each parent/guardian shall sign an LIC 9224 with copies maintained in each child's file. Every parent enrolling a new child in the FCCH shall receive a copy of the report and sign a LIC 9224 for the next twelve months. A copy of this report was reviewed and provided to the Licensee.

THIS REPORT MUST BE FILED IN FACILITY FILE AND MADE AVAILABLE FOR PUBLIC REVIEW FOR 3 YEARS. LPAs observed the "Notice of Site Visit" posted. FAILURE TO POST THE NOTICE OF SITE VISIT FOR 30 DAYS MAY RESULT IN A $100.00 CIVIL PENALTY.
