On August 18, 2025 an Informal Conference meeting was conducted today at the Santa Barbara Regional Child Care Office via Teams virtual meeting. In attendance during this meeting were: Licensing Program Manager (LPM), Ana Tolentino, Licensing Program Analyst (LPA), Bill Billones, and Licensee, Yesenia Mendoza. The purpose of the informal conference was to discuss previous citations in regards to an unannounced complaint inspection that was conducted on June 20, 2025. LPM Tolentino reviewed and discussed the inspection with Mendoza and how the Family Child Care Home will maintain compliance with the deficiencies cited below.

Community Care Licensing Division has determined that Mendoza Family Day Care Home violated the following Title 22 licensing regulations:

On June 20, 2025, during a complaint investigation inspection, a Type A deficiency was cited under Title 22 CCR 102416.5(f) - Staffing Ratio and Capacity (f) The total licensed capacity for a Large Family Child Care Home shall not exceed fourteen children.

This requirement was not met as evidenced by LPAs observation of 22 children in care at the time of inspection, which posed an immediate health, safety or personal rights risk to children in care.

On June 20, 2025, during an annual random inspection, a Type A deficiency was cited under Title 22 CCR 102416.5(d)(1) - (d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (1) Twelve children, no more than four of whom may be infants.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

This requirement was not met as evidenced by LPAs observation of 5 infants, 7 older children, and 8 school age children present in the home, which posed an immediate health, safety or personal rights risk to children in care.

On June 5, 2023, during an annual inspection, a Type A deficiency was cited under Title 22 CCR 102370(d)(1) - (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department.

This requirement is not met as evidenced by LPA’s observation and record review an assistant was not fingerprint cleared or associated with the facility, which posed an immediate health, safety or personal rights risk to children in care.

On June 5, 2023, during an annual inspection, a Type B deficiency was cited under Title 22 CCR 102416.5(e) - (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c).

This requirement is not met as evidenced by LPA’s observation of one assistant providing care and supervision to 8 children all under the age of 5 years which posed a potential health, safety or personal rights risk to children in care.

COMPLIANCE PLAN

In response to these discussions, Licensee has agreed to the following:

  1. Licensee will ensure children are provided with a safe and healthy environment.
  2. Licensee shall attend a Family Child Care Orientation in person. The next available dates are October 15, 2025 (conducted in English) and November 22, 2025 (conducted in Spanish). Location is 805 A Fiero Lane, San Luis Obispo , CA 93401. Orientation will last from 9:00 AM to 1:00 PM.
  3. Community Care Licensing will increase frequency of site visits to the facility to monitor compliance.
  4. Licensee agrees to be referred to the Technical Support Program (TSP).
  5. Licensee will adhere to strict compliance with all Title 22 capacity regulations and ratio limitations.
  6. Licensee will ensure all adults working or volunteering in the facility shall be fingerprint cleared and associated prior to initial presence in a licensed family child care home.
  7. In addition, it is recommended Licensee takes classes with Resource and Referral agency for additional support and training. The Santa Maria office can be reached at (805) 925-7071.

Today, August 18, 2025, Licensee is informed any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action.

Furthermore, Licensee understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties.

Upon receiving this report, provide copies of this licensing report to each parent/guardian of children currently enrolled and parents/guardians of newly enrolled children during the next 12 months.

Acknowledgement of Receipt LIC 9224 form shall be used for this purpose. LlC 9224 shall be completed and maintained in each child's file. LIC 9224 was provided to Licensee, Yesenia Mendoza.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiencies are cited during today's Office Conference.
