On August 6, 2026, at 1:00 PM, Licensing Program Manager Maria Mueller and Licensing Program Analyst Gigi Reyes met virtually with Licensee/Owner Erin Metcalf, Teachers Amy Evans and Dessura Lorencz to review findings from recent incidents at the Child Care Center.

This office meeting was conducted to address deficiencies and violations of Title 22, Division 12 of the California Code of Regulations identified during the complaint investigation involving the Child Care Center (CCC). The purpose of the meeting was to review the substantiated findings, address the licensee’s regulatory responsibilities, and discuss corrective measures necessary to ensure ongoing compliance with applicable regulations and to protect the personal rights, health, and safety of children in care.

The complaint investigation substantiated multiple incidents involving Staff 1 that occurred on the same day and involved three children. The conduct included smacking a child, pulling a child’s hair, and using a hose to spray two children. The investigation also identified additional inappropriate and prohibited disciplinary practices, including the use of hot sauce or lemon in response to biting and ridiculing a child experiencing difficulties with toilet training

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

. Such conduct constitutes violations of children’s personal rights and reflects deficiencies in the facility’s oversight, supervision, and implementation of appropriate discipline practices. The investigation also identified failures related to required reporting obligations.

Although the licensee was not personally involved in the reported incidents, the licensee remains responsible for ensuring that all staff comply with applicable Title 22 regulations and that children are protected from inappropriate or harmful treatment while in care. The licensee acknowledged this responsibility during the meeting.

The discussion emphasized the seriousness of the violations and the need for immediate and sustained corrective action. The licensee was advised of the responsibility to ensure appropriate staff supervision and monitoring, implement and enforce compliant discipline practices, provide staff with appropriate training and guidance regarding children’s personal rights, and ensure timely compliance with all applicable reporting requirements. The licensee was further advised that corrective measures must be effective and maintained to prevent recurrence and ensure the CCC provides a safe, appropriate, and regulatory-compliant environment for all children in care.

The office will continue to monitor the facility’s compliance and may take further administrative or enforcement action, as appropriate should additional violations occur or identified deficiencies not be adequately corrected.

The Department’s Legal Division reviewed the matter and determined that, because the employee is no longer employed at the Child Care Center (CCC), a non-immediate exclusion action against the former employee is appropriate and will be pursued by the Department.

The Director/Licensee was advised that the Department considers the identified deficiencies serious and that continued compliance with Title 22, Division 12, California Code of Regulations (CCR), is required to protect the health, safety, and personal rights of children in care. The Licensee was further advised that compliance with the following corrective measures is mandatory and will be subject to Department monitoring and verification.

Following the discussion, the Licensee agreed to the following Compliance Plan and corrective actions:

1. Compliance Plan Effective Date
Effective August 6, 2026, the Child Care Center will be placed on a compliance plan. The Licensee shall demonstrate sustained compliance with all applicable provisions of Title 22, Division 12, CCR, and shall ensure that corrective measures identified during the meeting are implemented and maintained.

2. Increased Department Monitoring
The Department will increase monitoring of the CCC through unannounced inspections and other appropriate oversight activities. These inspections may be conducted to verify compliance with Title 22 requirements, assess the effectiveness of corrective actions, and ensure the ongoing protection of children’s personal rights, health, safety, and well-being

3. Written Corrective Action Statement
No later than
September 7, 2026, the Licensee shall submit a written statement to the Department identifying the corrective actions implemented by the CCC in response to the deficiencies identified during the investigation. The statement shall specifically describe the measures taken to prevent recurrence and how compliance will be monitored and maintained.

4. Enhanced Care and Supervision Protocols
No later than
September 7, 2026, the Licensee shall submit updated written care and supervision protocols demonstrating enhanced oversight of children and staff. The protocols shall clearly identify staff responsibilities, supervisory expectations, and procedures implemented to ensure that children are appropriately supervised and protected at all times while in care.

5. Required Staff Training and Written Verification
The Licensee and all staff shall complete online training addressing
children’s personal rights and applicable reporting requirements. No later than September 7, 2026, each staff member shall submit a written statement documenting completion of the training and identifying the knowledge gained from the training. The written statements shall also describe how the staff member will apply the information learned to protect children’s personal rights and ensure compliance with licensing requirements.

6. Licensee Accountability and Oversight

September 7, 2026, the Licensee shall submit a written statement explaining how she will ensure continued and full compliance with Title 22, Division 12, CCR. The statement shall specifically address:

The Director/Licensee was informed that the Department consulted with the California Department of Social Services (CDSS) Legal Division regarding the circumstances of the incident and the former employee involved.

The Licensee/Owner, Erin Metcalf, acknowledged the Department’s concerns, the seriousness of the identified deficiencies, and the corrective measures discussed during the office meeting. The Licensee agreed to implement and maintain the above corrective actions and to operate the Child Care Center in full compliance with Title 22, Division 12, California Code of Regulations, at all times.

The Licensee was advised that implementation of the Compliance Plan does not relieve the Licensee of the responsibility to comply with all applicable laws and regulations. Compliance with the corrective measures identified above will be subject to Department verification and ongoing monitoring. Failure to implement, maintain, or demonstrate sustained compliance may result in further regulatory or enforcement action, as authorized by law.

The Licensee is responsible for ensuring that the Director and all staff are adequately trained, appropriately supervised, and held accountable for compliance with applicable licensing requirements. The Licensee shall take immediate corrective action upon identification of any violation or practice that may jeopardize the health, safety, or personal rights of children in care.

The measures that will be implemented to protect and preserve the personal rights of all children in care;
  • The Licensee’s oversight and supervision of the Director;
  • The Director’s oversight and supervision of staff;
  • Procedures for ensuring staff understand and consistently follow applicable licensing requirements;
  • Methods for monitoring staff performance and identifying and correcting noncompliance; and
  • Measures implemented to prevent recurrence of the deficiencies identified during the investigation.
7. CDSS Technical Support Program (TSP)
The Licensee was provided information regarding the CDSS Technical Support Program (TSP), including a TSP informational flyer. The Licensee was advised that TSP may provide technical assistance to support the CCC in achieving and maintaining compliance with licensing requirements. Should the CCC elect to participate in TSP services, the Licensee shall contact LPA Reyes to facilitate the referral.


Licensee Acknowledgment and Continuing Responsibility.

Upon receipt of this report, licensee shall post this at the CCC, and provide copies to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
