Licensing Program Analyst (LPA) Jennifer "Jen" Beehler conducted an unannounced case management inspection to investigate the incident that occurred on 01/17/2025. LPA was granted access by Assistant Director Maggie Corral and provided access to the facility.

Acting Director Marissa Munoz arrived shortly after. LPA conducted an interview with the Director and walked through the incident on the playground and classroom with the Director. LPA observed the playground was fenced in and locked from outside access. There are large windows all around the classroom and the door to the classroom is mostly glass. This allows visual capability to a majority of the playground from the classroom door and the large windows.

Director described the incident occurring during transition from outside play time to lunch inside. Teachers were using the face to name checking system which involves teachers to utilizeing a name list and check off each child as their face is recognized. The child was checked in, but went behind the teacher's back to enter back onto the playground. When the teacher completed her check, she closed the door without looking behind her. The secondary teacher saw the child standing on the other side of the door a few steps away and notified the first teacher. The first teacher turned around and immediately opened the door and let the child in. LPA did determine there was an absence of supervision, but it did not pose an immediate threat to the child's well being.

Director was immediately notified by the teachers of the incident and the Director immediately notified the parent of the child and discussed the incident in depth. Director conducted a training with all staff on 01/22/2025 on face to name verification, transition procedure and practiced different scenarios with the staff. Director stated new procedures for transitioning would include teachers holding the door open with their backs flush to the door so that there is only one way for children to enter or exit.

Teachers will also do a final sweep looking around the entire area before closing any doors. Director also stated for the interim, management is supervising all transitions from the playground to the classrooms to insure that the new procedures are being handled in accordance with the directive. Management will provide feedback or corrections until it is clear all staff members are adhering to the procedural change and transitions are secure for all children.

Due to today's inspection one Type B Citation was issued and a Civil Penalty of $500 was cited. More information provided on the attached LIC809-D and LIC421IM.

Director provided proof of the training conducted and procedural changes enacted, due to these actions the plan of correction was cleared during today's inspection.

Exit interview conducted with Acting Director Marissa Munoz, report reviewed and provided along with appeal rights. NOTICE OF SITE VISIT PROVIDED AND MUST REMAIN POSTED FOR 30 DAYS.

01/22/2025 Director conducted an all staff training on transitions using the face to name check system. Procedures were changed to include teachers opening the doors with their bodies and staying flush to the door so children have one way to enter/exit. Teachers practiced different scenarios. Management will monitor transitions insuring new procedures are adapted and maintained.

This requirement has not been met as evidenced by: on 1/17/2025 teachers closed the door to the playground leaving child outside. This posed a potential risk to the health and safety of the child in care.
