Licensing Program Analyst (LPA) Deanna Villagrana met with licensee Elida Gaeta to open complaint for above allegation. Present were licensee, licensee's husband, licensee's daughter and five day care children including one infant.

Based on LPA's interview which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Licensee admitted to using off limits living room one day and had two children with her and her husband watching TV while she rested as she was not feeling good. California Code of Regulations, Health and Safety Code 1596.80, are being cited on the attached LIC9099D.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. This requirement was not met as evidenced by Licensee admitted to using off limits living room one day and had two children with her and her husband watching TV while she rested as she was not feeling good.
