Licensing Program Analyst(LPA)Anna Morales conducted a unannounced complaint investigation today and met with Director Yareli Martinez to deliver investigation findings.
During the course of this investigation, LPA conducted interviews with staff, parents and reviewed supporting documentation.
Based on the information obtained, Facility did report an outbreak in a timely manner to the parents and posted on the front of the classroom doors an Exposure Notice in May 2025, for Hand, Foot and Mouth disease. Facility, also, posted an Exposure Notice for December 2024, for Respiratory Syncytial Virus(RSV). However, Facility failed to report two or more cases of Hand, Foot and Mouth disease in May 2025, and Respiratory Syncytial Virus(RSV) in December 2024 to Community Care Licensing.

According to the facility's diaper policy, children are to be changed every two hours or as needed. LPA reviewed supporting documentation stating that on 3/26/25, a child(C1) was last changed at 2:46pm by Staff(S2). Parent/responsible party picked up C1 at 4:09pm, and found C1 in a soiled diaper. LPA interviewed S2 who confirmed that they changed C1's diaper at 2:46pm, and documented it on the diaper changing log. Supporting documentation reviewed states that the facility completed an investigation and recognized that C1 had remained in a soiled diaper for approximately 1 hour and 25 minutes.

Based on LPA’s observations, records reviewed, and interviews conducted the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on the next page. Licensee/Director was informed that failure to correct the deficiencies may result in civil penalties.

Reporting Requirements: Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event.

Director Yareli Martinez, agreed to submit a written Plan of Correction indicating what steps the Facility will implement to ensure that the Facility will report all epidemic outbreaks to the Dept within the required time frames as noted in the Department's reporting requirements.

This requirement was not met as evidenced by: Facility did not report the epidemic outbreak in December 2024 and May 2025, to the Department(Community Care Licensing) as required. This presents a potential risk to the health, safety, or personal rights of children in care.
