Licensing Program Analyst (LPA) Deanna Villagrana met with licensee Rosario Martinez for an annual/random visit. LPA explained the nature of today’s inspection to her. Present were licensee, licensee's husband and four day care children including one infant. Days and hours of operation are Monday to Friday, 7:30am to 5:30pm. The adults that reside in the home are licensee, her husband, with their 16 year old daughter.

A review of staff records on 09/19/2024 indicates that not all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee's daughter Nekane Garay was present in the home for at least five days from 05/03/2024 through 09/21/2024 without fingerprint clearance. Licensee Rosario Martinez was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA toured the indoor and outdoor areas of the home during today’s inspection. LPA observed that the home is clean and orderly, with heating and ventilation for safety and comfort of the children. LPA observed a barricaded fireplace in the home. LPA observed safe and sufficient materials, toys, and play equipment for the day care children. LPA observed room additions including a day care room and bathroom in the home. Licensee failed to inform the Department of changes. LPA informed licensee these additions to the home may not be used until a fire clearance is obtained. LPA observed adult scissors on a children's table in the day care room and a knife on a patio table near in the backyard playground accessible to children. LPA observed an infant sitting in a high chair not being fed. LPA explained to licensee high chairs are only for feeding and children may not be detained in such items. LPA observed a fully charged 2A10BC fire extinguisher a working smoke and carbon monoxide detector. Licensee states there are no weapons/firearms in the home.
