13 | Licensing Program Analyst (LPA) Janette Cruz conducted an unannounced complaint investigation and met with Michael Zamudio, Licensee. Purpose of today’s inspection: deliver investigation findings. LPA also observed two infants, two preschool children, Licensee's spouse/staff Jennifer Zamudio and Licensee's niece/staff, Lyneth Zamudio, present at the facility during today's complaint investigation. LPA toured indoor and outdoor areas of the home.
Based on observations, record reviews and interviews conducted, it was discovered that per allegation provider forced children to help with inappropriate tasks, such as taking out the trash and picking up dog’s feces. It was also discovered that provider forced children to do inappropriate exercises such as performing push-ups as form of discipline. During today's visit, LPA observed objects with sharp edges such as rolled fenced wire, metal strip and a rake accessible to the children located at the backyard. The preponderance of evidence standard has thus been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 12 & Chapter 1), is being cited on the attached LIC 9099-D. Copy of appeal rights provided to Michael Zamudio, Licensee, prior to conclusion of today’s inspection.
A Notice of Site Visit is issued and must be posted near the entrance of the facility along with a copy of today's report for 30 days.

(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:
(1) To be treated with dignity in his/her personal relationship with staff and other persons.
