On 09/18/23 at 08:45 AM, Licensing Program Analysts (LPAs), Teodoro Trujillo and Fermin Campos-Jaramillo, met with director, Maria Atkins, for an annual inspection and explained the nature of today's visit to them. LPAs toured the Facility both inside and outside for today's inspection. LPAs observed the required posted materials, including the Facility License, Emergency Disaster Plan (LIC 610), Earthquake Preparedness Checklist (LIC 9148), Parents' Rights Poster (PUB 393), Personal Rights (LIC 613A), Child Car Seat Law, Menus, and Activity Schedule. There are no active waivers at this time.

Facility is currently licensed for a capacity of 18. The program currently operates 7 AM to 6 PM, Monday thru Friday. Licensing staff was taken on a guided tour walk through of the facility. This is a preschool program which consists of three classrooms; Room 1 thru 3. The preschool currently only utilizes Room 1. LPA notes that Rooms 2 & 3 are not approved for use at this time per the fire clearance. LPA observed rooms 2 and 3 have water damage in ceiling and rooms have a wet/musty smell, director states room has been leaking and are attempting to dry both rooms. Director Atkins understands licensing needs to be notified in the case that there are any changes to the rooms and/or playground area being utilized. All areas identified on the Facility Sketch were inspected. Upon arrival, the following staff were present during this inspection: Room 1: Director Atkins with seven preschoolers. The total census was twelve preschoolers in todays visit and co-licensee David and Maria Atkins and volunteer Patricia.


LPAs Trujillo and Campos-Jaramillo inspected the inside areas of the facility. LPAs Trujillo and Campos-Jaramillo inspected Room 1 and observed furniture and equipment is age appropriate and in sufficient condition. Telephone service, heating, lighting and ventilation were evaluated and meet licensing standards. Storage for children's belongings was observed as compliant. Mat/cots were inspected and sanitary. Blanket are brought children's home. Availability of drinking water was reviewed. Toys observed to be sanitary and age appropriate.
LPA observed age appropriate sinks and toilets and were inspected for availability, water temperature, toilet paper, area safety and sanitation. There are a total of 2 toilets and 2 sinks available for the preschool children. Director Atkins states potty training is provided by the Facility. LPAs Trujillo Campos-Jaramillo observed the children's sinks are in working condition and meet licensing standards. LPAs Trujillo and Campos-Jaramillo observed soap dispenser and disposable towels in the preschool bathrooms. Staff have one separate bathroom that can be utilized by sick children if necessary. Sick children are isolated in the room next to children bathroom.

LPAs Trujillo and Campos-Jaramillo observed a first aid kit is kept in Hallway one and in Room 1. LPAs observed functioning Carbon monoxide and two smoke detectors not working in the facility. LPAs Trujillo and Campos-Jaramillo observed at least one 3A40BC fire extinguisher, last serviced on 01/26/23. Hazardous items including poisonous cleaning compounds were accessible to children, a can of air freshener spray refill and bottle of skin moisturizer accessible by hallway door entrance to facility bathroom. All trash receptacles have tight fitting covers. At the time of the inspection, LPAs observed at least 2 size appropriate tables and 20 chairs available for use. Director Atkins states there are no weapons on the premises.

Snack/lunch menus were reviewed. Food and snacks were reviewed for availability, quantity and appropriateness to children in care. Lunch is brought from home. There a microwave in an adjacent room. LPAs observed various religious alters with food and glass filled liquids and food items that are accessible to varmints with snacks that are being provided to children in directors office.

LPAs observed all outdoor activity areas. LPAs Trujillo and Campos-Jaramillo observed that the preschool playground is surrounded by appropriate fencing. Shade is provided by trees and a canopy. Drinking water is provided by pitchers of water and water bottles brought by children in care outdoors. There are adequate equipment, supplies, and toys for children outdoors. Play area was inspected for hazards and inaccessibility to bodies of water; no bodies of water or hazards observed. Transportation will not be provided by the Facility. Outdoor equipment was inspected for safety, cushioning material, sufficient repair and appropriateness. LPAs advised that the children need to be within the direct care and supervision, including visual supervision of the teacher(s) at all times.
LPAs Trujillo and Jaramillo observed facility was in compliance with the following: Teacher child ratios, staff names recorded. Care and supervision was evaluated to determine if the basic needs of children are met and appropriate. Sign-in and out sheets and procedures were reviewed. Personal Rights of children were observed by LPAs.

LPAs Trujillo and Campos-Jaramillo reviewed seven children's files and observed current and updated immunization records, Admission agreements and Notification of Parents' Rights forms (LIC 995A) in each file. LPAs observed Child 1(c1) c2, and c3 missing CDPH286. LPAs Trujillo and Campos-Jaramillo observed that the Director Atkins has record of MMR & Tdap vaccinations as well as for the flu vaccine. LPAs Trujillo and Campos-Jaramillo observed a roster with child c1, c6 and c7 missing from facility roster, a current fire disaster/earthquake drills last log 07/14/2023. Director Atkins states she has day care insurance. Director Atkins has the required units and all other qualifications currently required.

A review of staff records on 09/17/23 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee Maria Atkins was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. .

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

Type A and Type B Deficiencies were cited today. Licensee was informed that failure to correct the deficiencies by the specified Plan of Correction Due Date will result in assessment of civil penalties in the amount of $100 per day per violation until the correction is made.

Type A deficiencies were cited during today's visit. LPA Teodoro Trujillo and LPA Fermin Campos-Jaramillo informed licensee Maria Atkins and David Atkins that this report dated 09/18/2023 documents 1 (one) Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPAs informed the licensee Maria Atkins and David Atkins to provide a copy of this licensing report dated 09/18/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with the licensee Maria Atkins and David Atkins.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
