Licensing Program Analysts (LPAs) Harsimran Kaur and Janette Cruz conducted an unannounced case management inspection in response to a request for change of capacity from 80 to 96 preschool children. LPAs met with Kristine, Director, and explained to her purpose of today’s inspection. The Preschool Program currently serves children ages 2 years - entry to first grade in preschool rooms 1, 2, 3, 4 operating in a functioning elementary school, Gardner Academy. The Facility received a fire safety inspection approval from the San Jose Fire Department for the change of capacity on 06/11/24. The child care center will operate Monday–Friday 7:00 AM – 6:00 PM. LPAs toured and measured the indoor and outdoor areas of the Facility during today's inspection. The facility also has a licensed school age program ( Facility # 434415730) on the same premises in rooms in school-age rooms SAC1 and SAC2. LPAs toured and measured the indoor and outdoor areas of the facility during today's inspection. The facility has a total of 4 classrooms (Room 1, room 2/SAC1. 3 and 4). Room 2/SAC1 will be only used during the hours from 9AM to 12PM.

Preschool Classroom measurements are:
The Indoor total measurements contain a total of {4657.29} square feet, which will accommodate Applicant's request for 96 preschool children.

Preschool Outdoor Play measurements are:
Outdoor total measurements contain a total of {2822.86} square feet, which will not accommodate Applicant’s request for 96 preschool children.

LPAs observed classrooms are clean, safe, sanitary and in good repair. All outdoor and indoor passage ways and other areas of potential hazard were free of obstruction. A comfortable temperature for children shall be maintained at all times. Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts. All play equipment and materials used by children
were observed to be age-appropriate. There are 123 chairs, 24 tables, 111 cubbies, 70 cots/mats
10 toilets, and 15 sinks available for preschool children. There is a separate staff toilet not utilized by the children which an isolated child can use if needed.

LPAs observed that the teacher/child ratio was in compliance during today's visit. The
facility serves lunch and snacks to the preschool children. The Applicant shall take measures to keep the center free of flies, other insects, and rodents. Lunch and snacks are prepared off site by provider Chefables. LPAs advised Applicant as per Title 22, if food is prepared off the center premises, the following shall apply: (A)The preparation source shall meet all applicable requirements for commercial food services.(B) The center shall have the equipment and staff necessary to receive and serve the food and to clean up.(C) The center shall maintain the equipment necessary for in-house food preparation, or shall have an alternate source for food preparation and service in the event of an emergency. Commercial foods shall be approved by appropriate federal, state and local authorities. All foods shall be selected, transported, stored, prepared and served so as to be free from contamination and spoilage and shall be fit for human consumption. Drinking water is readily available for the children via water dispenser from filtered water source. LPAs observed that facility has a kitchen area kept off limits to children equipped with refrigerator and microwave.

LPAs observed that the preschool playgrounds are surrounded by appropriate fencing. The preschool playgrounds have climbing structures with sufficient resilient materials (poured rubber). There is adequate age appropriate supplies and toys outdoors. Shade is provided by an umbrella and canopy. LPAs observed no bodies of water. Based on today's inspection, LPAs determined that the facility's physical plant is in compliance with applicable Health & Safety Codes and Title 22 Regulations.

LPAs conducted an exit interview and advised Director that request for increase in capacity from 80 to 96 preschool children will be approved upon completion of the following:

1. Waiver for shared preschool playground use.

An exit interview was conducted and a copy of appeal rights and this report was provided to Kristine Nguyen, Director. Final license determination will be made upon review by the Licensing Program Manager and approval of above condition. No deficiencies issued during today's inspection

A notice of site visit was given and must remain posted for 30 days.
