On 01/16/2025, Licensing Program Manager (LPM) Gladys Kuizon and Licensing Program Analyst (LPA) Farida Raja met with Licensee Nancy Sharma for a scheduled Informal Meeting at the San Jose Regional Office. The purpose of the Informal Meeting was to discuss recent citations issued and repeat citations for previous violations.

1. Fingerprint Clearance:

· On 08/28/2019, Licensee received a TYPE A citation for failing to obtain fingerprint clearance for assistant prior to employment. `

2. Ratio:

· On 08/28/2019, Licensee received a TYPE A citation for operating out of ratio by caring for 7 children including 5 infants and 2 preschool age when licensed as a small family childcare home.

· On 08/20/2024, Licensee received a TYPE A citation for operating out of ratio by caring for 13 children including 3 infants and 10 preschool age without an assistant.

· On 12/09/2024, Licensee received a repeat TYPE A citation for operating out of ratio by caring for 12 children including 6 infants and 6 preschool age without an assistant.

3. Roster:

· On 08/28/2019, licensee was cited for failure to maintain a roster.

· On 07/20/2022, licensee was cited for the same deficiency.

· On 08/20/2024, licensee was cited again for failing to maintain a current roster.

· On 12/09/2024, licensee was cited a repeat violation for failing to maintain a current roster.

4. Personnel Records:

· On 08/20/2024, licensee was cited for failing to maintain employee records including mandated reporter training certificate for her assistant.

· On 12/09/2024, licensee was cited for lacking immunization records for assistant.

5. Children’s Records:

· On 08/28/2019, licensee was cited for failure to maintain Notification of Parents’ Rights (LIC 995A) for several children in care.

· On 08/20/2024, licensee was cited for failure to maintain immunization records and consent for emergency medical treatment (LIC 627) for several children in care.

· On 12/09/2024, licensee was issued repeat citations for the deficiencies.

6. Infant Safe Sleep:

· On 08/20/2024, licensee was cited having loose articles inside a crib during nap time, failure to maintain individual infant sleep plans (LIC 9227) and failure to conduct and document 15-minute nap checks for all sleeping infants.

· On 12/09/2024, licensee was issued repeat citations for failure to conduct and document 15-minute nap checks for sleeping infants.

7. Operation of a Family Child Care Home:

· On 08/28/2019, licensee was cited for failure to conduct fire drills and maintain a log.

· On 08/28/2019, licensee was also cited for failure to label children’s items (milk bottles) provided by parents/authorized representatives.

8. AB 633 Requirements

· On 12/09/2024, licensee was cited for failure to maintain the Acknowledgement of Receipt of Licensing Reports (LIC 9224) in children files for verification.

Licensee has previously attended an informal office meeting on 09/12/2019. During today’s Informal Meeting, Type A and Type B citations were discussed with Licensee. The purpose of the informal meeting today is to review the deficiencies with Licensee and discuss the plan of corrections submitted by the licensee to ensure licensees understanding of Title 22 violations that led to the deficiencies.

LPM, Gladys Kuizon explained to Licensee the seriousness of these violations and that if there is continued non-compliance, the day care home may be referred to the Legal Department for possible administrative action, which could include revocation of the day care license. The day care home will be monitored more frequently to ensure that Licensee is operating in compliance with all applicable laws and regulations.

During today's meeting, LPM Kuizon and LPA Raja also discussed the regulation of ratios, personnel requirements including fingerprint clearance, immunization records and all other employees' required documents, required documents for children before enrollment, and infant safe sleeping regulations.

LPM Kuizon and LPA Raja also discussed the Technical Support Program Training with the licensee, and provided the following documents to licensee: Capacity Regulation flyer, LIC 311D and sample 15 minute nap check form.

During the meeting, the licensee confirmed that she have understood all the regulations and requirements we discussed today. LPM Kuizon discussed with the Licensee the Plan of Correction submitted for the citations.

Licensee to submit a current roster to LPA by 01/20/2025. Licensee's compliance plan will include:

Licensee to submit an updated roster every time a new child enrolls.
Licensee to submit all children's enrollment forms for every child enrolled for the next 12 months.
Licensee to submit a copy of the 15 minute nap checks for 3 infants in care by 01/20/2025.
Licensee to submit an updated LIC 500 (Personnel Record) every time Licensee hires a new staff.

LPM Kuizon also discussed the requirements of AB 633 with Licensee and provided her with the AB 633 fact sheet and a copy of LIC9224 "Acknowledgement of Receipt of Licensing Reports."

This report was reviewed with Licensee and a copy was provided to Licensee at the conclusion of the Informal.
