On 12/19/2024, Licensing Program Analysts (LPAs), Farida Raja and Pedro Solorio-Gutierrez, met with Staff, Priti Pathak, for an unannounced annual/random inspection in the Infant Program. LPAs informed staff regarding the purpose of the visit. Staff stated that Director will be at the facility shortly. Director, Sabrina Fenech arrived during the facility walk through. The facility is licensed to serve 12 children ages 0-2 years in the infant room. Facility has an preschool program (#434416175) at the same location. LPAs observed the required posted materials near the facility entrance and menus and lesson plans near the entrance to infant classroom. Days and hours of operation are Monday through Friday, 7:00 AM to 6:00 PM.

LPAs and Director toured the indoor and outdoor areas of the Infant Program during today's inspection and observed 8 children and 4 staff. Facility was in compliance with teacher to children ratio requirement.

Classroom, staff restrooms and kitchen area were inspected. Facility has central heating/cooling for comfort of children. Director states that there are no weapons or firearms on the premises. There is a working telephone at the facility. Disinfectants, cleaning products and medicines were observed to be stored inaccessible to the children in locked or high cabinets. Furniture and equipment were age appropriate and in good condition, free of sharp, loose, or pointed parts. LPAs observed solid waste containers with tight-fitting lids in the rooms and inaccessible trash cans under diaper changing table for the disposal of diapers. Changing table is appropriate with raised sides and vinyl changing pad that is at least 1 inch thick. Staff have two separate bathrooms. Napping area and cribs are appropriate. Mattresses were observed with tight fitting sheets and free of loose articles and objects.

LPAs observed fully charged fire extinguishers and working smoke and carbon monoxide detectors. Log shows that the last Fire Drill was conducted on 12/12/2024 which is compliant with the six-month requirement for facilities.

Drinking water is readily available for children indoors via individually labelled bottles and in the outdoor area using a water cooler and disposable cups. Water lead testing was completed by the facility on 09/07/2023 and no Action Level Exceedances were reported.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

LPAs verified that water lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP and obtained a copy of the LIC 9275, LIC 9276 and facility sketch indicating water outlets tested during today's inspection. LPAs provided Director with the Water Lead Report from the California State Water Resources Control Board during today's inspection. Director stated that two water outlets (kitchen and infant classroom) were tested and the water pitchers and coolers are filled using the tested water. No other outlets including drinking water fountains indoors and outdoors are used for drinking or food preparation purposes. LPAs observed that the drinking water fountains in the outdoor areas do not dispense water.

The facility provides two meals (breakfast and lunch) and one snack. Director stated that meals are prepared by the facility's main kitchen at the San Juan site and delivered to this facility. Food storage and preparation areas were observed to be sanitary. All food and beverages that require refrigeration were stored in covered containers. LPAs observed containers and bottles were labelled with children's names. Trash cans for solid waste had tight-fitting covers.

Outdoor playground and play equipment was inspected and observed to be fenced in and free of hazards. LPAs observed play equipment was in good condition, age-appropriate, and has sufficient rubber material around and under high climbing structures and slides to absorb falls. Shaded rest area is provided by canopies. No bodies of water were observed. Sandbox was not covered but observed free of hazardous foreign objects. Children in the toddler component and infant program share the toddler yard at different times and Director stated that these children do not commingle at any time.

A sampling of 4 children and 2 staff files was selected for review. Children sign in and out procedures and logs were reviewed. Children's roster was reviewed. Each child's file reviewed contained the required forms including 15 minute nap checks and needs and services plans.

LPAs discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A review of staff records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. All staff files reviewed contain the required transcripts/verification of experience. At least one staff member on site has a current CPR and First Aid certification. Director understands that there shall be at least one person, with valid CPR and First Aid certifications, on site at all times or present during off-site activities (field trips). All staff have the required immunization's against pertussis, measles and statement declining the influenza immunization. LPAs observed required Mandated Reporter Training on file for all staff.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. Facility has an approved IMS Plan on file with San Jose Regional Office. Director stated that facility does handle medications and currently does not have children in care who require Incidental Medical Services.

LPAs observed that medications at the facility are stored in a lock box on a high cabinet in each classroom. Isolation of sick child was discussed, and Director explained that sick children will be isolated in the director's office and isolation equipment will be provided. A staff restroom which is off limits to other children is used if necessary. Child is always under visual supervision while in care of the facility. Facility does not provide transportation to children. Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

As a result of today's inspection, there were no deficiencies cited. Exit interview conducted and report was reviewed with Director, Sabrina Fenech.
