13 | On 01/07/2026, Licensing Program Analyst (LPA) Mandeep Kaur met with Director Dieu-Mi Le, for an unannounced follow up complaint investigation. Purpose of today's investigation: deliver investigation findings. LPA conducted complaint investigation comprising of observations, random staff interviews, random parents interviews, random children interviews, records review and evidence gathered.
On 11/20/2025, Director self-admitted that there was a one teacher (S1) with 13 children in a classroom for a few minutes, right after the nap time on 11/18/2025 before Director stepped into the teacher-child ratio. On 11/20/2025, LPA observed expired food during investigation. Director stated that the expired food is in the freezer as they have missed to take it out of the freezer, but expired food is not served to the children in care.
Based on LPA observations, interviews, records review and evidence gathered, which were conducted, the preponderance of evidence standard has been met, therefore the above allegations is found to be SUBSTANTIATED.

Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.

7 | By plan of correction due date, 01/14/2026, Licensee will submit the written statement of understanding of Food services requirements and the future plan to store, prepare and serve food in a safe and healthful manner to the Department. On 11/20/2025, LPA observed that expired food was immediately removed out of the freezer and disposed. Director stated that the expired Tortillas and bread is in the freezer, but it never got served to the children, During the multiple complaint investigation visits after 11/20/25, LPA has not observed any expired food stored in the freezer or a fridge. Director has been advised to attend Preventive health and safety training with lead and nutrition. Director has completed the Preventative health and safety training with lead and nutrition on 10/30/2024. |

Based on interviews, observations, records review and evidence gathered during the investigation process, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED.
No deficiency issued during today's investigation. Appeal rights were provided.
Exit interview conducted and report was reviewed with Director, Dieu-Mi Le.
A Notice of Site Visit was given and must remain posted for 30 days. |
