Licensing Program Analyst (LPA) Oscar Huang conducted an unannounced case management visit to the home today. Licensee has requested to increase her licensed capacity to 14 children. Licensee has been licensed as a small Family Child Care Home since August 23, 2021 at the same location, and is thus eligible to apply for the capacity increase. LPA met with Licensee Bingmei Xu and explained the nature of today's visit to her. LPA also observed licensee and 5 day care children (2 preschoolers and 3 infants) in the home during today's visit. Days and hours of operation are Monday - Friday from 8:30 AM to 6:00 PM. The adults that reside in the home are the Licensee only. Licensee stated that her cousin is visiting from China lately, and has performed criminal record clearance. LPA observed her status passed on DOJ/FBI, but is still pending on CACI. LPA advised Licensee that her cousin can only in contact with her own son, but not with other children in care. LPA also advised that her school-age son will be accounted to her capacity when present during her operation hours.

A review of staff records on 04/10/2023 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violate

LPA observed Licensee has current CPR and First Aid certifications which are expiring 07/2023. LPA observed a current roster of the children and a fire and disaster drills log which is to be done at least once every six months. The last drills were conducted on 03/31/2023.

LPA reviewed all 5 children files. Immunization records are maintained and up-to-date, LPA observed Notification of Parents’ Rights is in each child’s file, and infant sleeping 15 min. check logs for two infants under 2 years old. The facility does not carry liability insurance, LPA observed Affidavit Regarding Liability Insurance form were signed by the parents of children in care and kept in each of the children's file.

Licensee requested to waive the Mandated Reporter Training as her primary language is Chinese. Licensee declined to take the flu shot this season, and a statement is on file.

Supervision of children was discussed with Licensee, and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options. Licensee states that she does not transport children via vehicle but she understands that children cannot be left in parked vehicles unattended at any time.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A fire clearance granted from the Santa Clara County Fire Department was received on 3/22/2023: Areas approved for us: Classroom, Living room, Bathroom, Kitchen, Master Bedroom (Infant Naps), Outdoor Play Area. Areas Off-Limits: Bedroom 2, Laundry. Fire Clearance Granted.

Based on today's inspection, LPA advised licensee that a Large Family Child Care Home license will be approved pending on the management approval:

No deficiency was cited. A notice of site visit was given and must remain posted for 30 days. The report was discussed and verbally translated into Chinese during the exit interview with Licensee, Bingmei Xu.
