32 | It was alleged that; Staff do not ensure children are spoken to in an appropriate manner, and lack of supervision resulting in children inappropriately interacting. Based on interviews conducted, Staff 1 (S1) stated they were taught to get down to eye level and speak to the child. She stated if a child pushes another child, staff will speak to the child and redirect them by saying “gentle hands, and be nice, by showing the child from right and wrong”. Staff 2 (S2) stated when speaking to children, staff need to be understanding and patient and try to understand where the child is coming from and how they are feeling. Staff mentioned they will speak to children in a respectful way because children can feel when a staff member is being mean or rude to the child. Staff 3 (S3) stated children shall be spoken to with respect and in a way where children can understand what staff are telling them. All 3 staff informed LPA when a child touches another child inappropriately, staff will tell the child it is not nice, and staff will re-director the child; Parents are informed as well.
It was alleged that; Staff handle children in a rough manner, and staff are providing false statements on incident reports. Based on interviews, and record review conducted, LPA reviewed a video recording in starfish class which indicated children are not being handled in a rough manner; LPA observed staff member picking up a child and letting the child go because the child did not want to be cleaned/changed, and staff left the child alone and proceeded to another child. LPA reviewed the centers bright wheel application and obtained copies of messages being sent to the child(ren)’s parents when an incident occurs; LPA received copies of incident reports which correlates to what staff are messaging parents on bright wheel. RP informed LPA there are two (2) staff witnesses that have seen the incidents occur, and LPA interviewed both witnesses and both witnesses informed LPA that it was not happening.
Based on interviews, record reviews, observations, and evidence gathered during the course of the investigation, it is concluded that although the allegations noted on this complaint may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. The allegations are UNSUBSTANTIATED.
