Licensing Program Analysts (LPAs) Mel Matos and Syeda Bahar met with Brandon Ferkel, Licensee, for an unannounced Annual/Random & capacity increase inspection. Note: Licensee’s residence is located in the Laurel Apartments facing Baypointe Parkway. Public Parking is available on the street and LPAs communicated with the Licensee via telephone to get access to the property. LPAs were granted access to the home by the Licensee. LPAs also observed six day care child (3 infants and 3 preschool) and Licensee’s spouse in the home during today's inspection. Licensee was operating within the capacity and ratio requirements of her license. LPAs observed the required postings, including the facility license, near the main entrance to the home. Days and hours of operation are Monday - Friday from 7:30 AM to 5:30 PM. The Licensee and his spouse (Bruna Correa De Araujo) are the adults residing in the home. There are no minor children residing in the home.

LPAs reviewed a current Child Care Facility Roster and Fire/Disaster drill log during today's inspection. The last fire/disaster drill was completed on November 12, 2024. Licensee states that he does have liability insurance through State National Insurance Co. and LPAs observed a valid policy verifying coverage. Licensee and his spouse has current CPR & First Aid certifications (expiration: 11/06/2025). Licensee and his spouse has the required vaccines (MMR, Tdap, & flu - opt out)) and are current with the Mandated Reporter Training for Child Care Workers (exp: 11/15/2025). Licensee rents the home and Owner/Landlord Notification (LIC 9151) form is on file. Licensee does not have the Owner/Landlord Consent (LIC 9149) form on file for the large license and understands that his capacity will be limited to 12 children. LPAs reviewed six children's files (3 infants & 3 preschool) and the files were complete with the required forms and immunization records. LPAs reviewed two staff files (Licensee and spouse) and the files were complete with the required forms and immunization records.

LPAs toured the indoor and outdoor areas of the home during today's inspection. Licensee has a working telephone in the home. The home is clean, orderly, (including proper heating/cooling/ventilation), and safe for the day care children. There are safe & age appropriate toys, play equipment, and materials for the children in the home. There are no open face heaters or fireplace units inside the home. There are no stairs, fireplace units, or wall heater units inside the home. Off limit areas inside the home: kitchen, bathroom (with the washer/dryer in it - closest to front entrance) and the bedroom located near the front entrance. There are no off limit areas outside the home. LPAs observed a community swimming pool in the middle of the complex that is adequately fenced with a self-latching gate. Licensee states that the swimming pool is only accessible to residents via key card. Licensee states that the day care children will not use the swimming pool. Applicant states that he does not have any pets or weapons/ammunition in the home.

LPAs observed a fully charged 2A10BC fire extinguisher, working smoke/carbon monoxide detectors, and fenced patio area. All detergents, cleaning compounds, medications, and other similar items are inaccessible to children. Licensee states that there are no poisons in the home. Licensee states that he provides breakfast, snacks, and lunch for the day care children. Licensee understands that any food brought from home shall be labeled with each child's name and properly stored. Licensee has a first aid kit in the home which includes a touch less thermometer. Licensee understands that smoking is prohibited in the home.

Licensee states that he does not administer any medications to the day care children at this time. For IMS information see PIN 22-02- CCP. Supervision of children was discussed with the Licensee and he understands that he must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands the capacity/ratio options and he understands that he cannot have more than 8 children present in the home without at least one qualified adult present. Licensee states that a child will be isolated in the on limits bedroom area if necessary due to illness or communicable disease. Licensee states that he does not transport any day care children. Licensee understands that children shall not be left unattended in parked vehicles and that car seats shall only be used for transportation and shall not be used for sleeping.

Licensee, Brandon Ferkel, was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPAs discussed the safe sleep regulations with the Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed the Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Fire clearance approval was received from the San Jose Fire Department prior to today’s inspection.

Exit interview conducted and report was reviewed with the Licensee, Brandon Ferkel. No deficiencies issued during today's inspection.

LPAs advised Licensee, Brandon Ferkel, that a large Family Child Care Home is approved effective today, January 9, 2025.

A Notice of Site Visit was given and must remain posted for 30 days.
