On 03/28/2024 at 2:45 pm, Licensing Program Analyst (LPA), Farida Raja, met with Director, Stefanie Nanez, for an unannounced Annual inspection in the Infant Program. The facility is licensed to serve children ages 6 weeks to 2 years in the infant and infant sleeping rooms. Facility has a preschool program (#434415865) at the same location. The facility has one waiver on file for commingling children between the infant and preschool components between 8-9 am and 4-5 pm. LPA observed the required posted materials including activity schedule near the entrance. Days and hours of operation are Monday through Friday, 8:00 am to 5:00 pm.

LPA toured the indoor and outdoor areas during today's inspection and observed the 4 infant children and two teachers. Facility was in compliance with teacher to children ratio requirement. Classrooms, staff restroom and kitchen were inspected. Infants were engaged in free play under the visual supervision of staff. Facility has central heating and uses wall/portable air conditioners for comfort of children. Director states that there are no weapons including firearms on the premises. There is a working telephone at the facility (408-429-8644). Disinfectants, cleaning products and first aid kit were observed stored inaccessible to the children in care. Furniture and equipment were age appropriate and in good condition, free of sharp, loose, or pointed parts. LPA observed appropriate changing table that have raised sides (3 inches in height) and have vinyl changing pad that is at least 1 inch thick and within arm’s reach of a portable sink. LPA observed a trash can with tight fitting cover for the disposal of diapers. Napping equipment is appropriate. LPA observed two baby bouncers in the infant nap room. No children were using the bouncers during today’s inspection.

LPA observed fire extinguishers, working smoke and carbon monoxide detectors, and fire pull stations. The facility has a built-in smoke detector/ fire system. Last Fire Drill was conducted on 03/28/2024. LPA reminded Director that fire drills need to be conducted and documented every six months.

Drinking water is readily available for children in each room and in the outdoor playground area via individual water bottles which are refilled using store bought water. Facility did not complete water lead testing prior to their deadline. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. LPA referred Director to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

All infants bottles and food are provided by parents and LPA observed bottles labelled with child's name in kitchen refrigerator. Director stated that parents provided insulated lunch boxes which are stored in infant's bags. Food storage areas were observed to be sanitary. All food and beverages that require refrigeration are stored in covered containers.

LPA observed the play area in the front yard is surrounded by appropriate fencing and the outdoor surfaces are safe for children. LPA observed that the play equipment is age appropriate, in good condition and free of hazards. LPA observed rubber mats and tan bark as resilient material to absorb falls. LPA discussed with Director about plans for obtaining more tan bark and having staff even out tan bark before children go outside. There are no bodies of water observed. Shade is provided by building overhang and trees. Director stated that both components use only the front play area and the backyard will be used during the summer. Director stated that infant and preschool children use outdoor play areas at different times or follow the conditions outlined in the waiver.

Director stated that they use electronic sign in and out but have not been implementing since the pandemic. LPA informed Director that each parent bringing and picking up children from the childcare center are required to sign children in and out with full legal signatures. Director did not have a children's roster for LPA to review. LPA provided Director with a copy of Childcare Facility Roster (LIC 9040) during today's inspection. LPA reviewed two (2) infant files during today's inspection. Each infant's file reviewed contained the required forms. Needs & Services Plans were on file. LPA reminded Director to update Needs and Services Plans at least once per quarter or more often if needed. Facility was in compliance with the Safe Sleep regulations/requirements, including the Infant Sleeping Plan (LIC 9227) and 15 minute nap checks.

Two (2) staff files were reviewed. A review of staff records indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Staff file for staff, S1 was not available at facility for LPA to review. At least one staff member on site has a current CPR and First Aid certification. LPA observed required Mandated Reporter Training on file for all staff.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies. Director stated that facility does handle medications but currently has no children in care who require Incidental Medical Services (IMS). Facility has an approved IMS Plan on file with San Jose Regional Office. Any medications at the facility are stored in a high cabinets and are inaccessible to children in care. Isolation of sick child was discussed, and Director explained that sick children will be isolated away from other children and isolation equipment will be provided. Child is always under visual supervision while in care of the facility. Facility does not provide transportation to children. Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
