Licensing Program Analysts (LPAs) Janette Cruz and Mel Matos, met with Margarita Saucedo, Applicant Representative, for the purpose of conducting an announced prelicensing inspection. The Applicant has applied for a infant (434417060, and preschool license (434417059) on the same campus (Cesar Chavez Early Learning Center). Note: Josefina Garcia has been designated as the new infant director and Margarita states that she will be submitting the pertinent director paperwork & documents for Josefina Garcia to the Department. LPAs toured and measured the indoor and outdoor areas of the Facility during today's inspection.

The Infant Program will operate Monday through Friday from 7:00 AM to 6:00 PM, serving infants ages 0 months to 2 years old. The Infant Program will be utilizing Infant Rooms 4 and 5.


INDOOR MEASUREMENTS ARE AS FOLLOWS:

Infant 4: 27.750 x 25.250 = 700.687 minus 35.543 (encumbered space) = 665.144

Infant 5: 32.500 x + 27.750 = 901.875 minus 35.543 (encumbered space) = 866.332

TOTAL INDOOR SPACE: 1,531.476 sq. ft. divided by 35 = 43 infants

There are 2 toilets (30) and 4 sinks (60) available for the infant children. Potty training will be provided by the Facility. There is no hot water available in the children's sinks. Staff have separate staff bathrooms, located in the administration office area of Cesar Chavez Elementary School, that can be utilized by sick children if necessary. Sick children will be isolated in the administration office area of Cesar Chavez Early Learning Center, and isolation equipment is available.

The Facility has adequate heating/air conditioning in all classrooms. LPAs observed barricaded wall heaters in all classrooms. All infant classrooms have appropriate lighting. First aid supplies are stored in each classroom inaccessible to the children. Medications will be stored in an appropriate lock box in each classroom inaccessible to children. There are functioning carbon monoxide detectors in each classroom. Margarita states that there are no firearms or weapons on the premises.

The food preparation area is functional and has hot and cold running water, sink, dishwasher, refrigerator, microwave, and storage space for food. The Facility will provide all meals, including breakfast and lunch to the children. High chairs or other appropriate seating equipment shall be used to seat infants during feeding. Infants shall be held during feedings if they are unable to sit unassisted. Propped bottles are not allowed. Cleaning and sanitation of dishes and utensils will be done via dishwasher. Disposable utensils and plates will be utilized by the Facility. LPAs observed a solid waste container with a tight-fitting lid in each classroom. Cleaning supplies will be stored on high shelves and locked cabinets in each Classroom inaccessible to children. Cleaning supplies will also be stored on high shelves in the infant room inaccessible to children.

There are 39 chairs, 6 tables, 50 cubbies, and 23 mats for the children. There is adequate equipment, supplies and toys for the infant children in each classroom. Margarita understands that walkers, and items of similar nature are not permitted. LPAs observed appropriate changing tables that have raised sides (3 inches in height) and are within an arm's reach of a sink in each classroom. There is a separate sleeping (crib) area in Infant Room 4 (separate from the indoor activity space) with a total of 5 cribs. Margarita understands that the infants must be under direct visual supervision at all times, including nap times, in the separate sleeping (crib) areas. Drinking water will be provided indoors/outdoors via water jugs/cups of water. LPAs advised Margarita of the lead testing requirement that the Facility must complete within 180 days of obtaining a license. There is a working telephone at the Facility. OUTDOOR MEASUREMENTS ARE AS FOLLOWS:

Infant Playground = 61.667 x 25.167 = 1,551.973
TOTAL OUTDOOR SPACE: 1,551.973 sq. ft. divided by 75 = 20 children.

This facility plans to provide Incidental Medical Services – IMS. For IMS information, see PIN 22-02-CCP. A Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm IMS Medications (Inhalers and EpiPens only) will be stored in each individual classroom inaccessible to children.

Margarita was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPAs reviewed with Applicant Representative the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

LPAs received a fire clearance approval from the San Jose Fire Department for 28 infant children prior to today's inspection.

Exit interview conducted and report was reviewed with Margarita Saucedo, Applicant Representative. LPAs advised her that a license for 28 infant children will be submitted to Licensing Management for the final stage of approval once the following item(s) have been received:
1) Required director paperwork & documents for Josefina Garcia, new infant director, has been received and approved.
