Licensing Program Analyst (LPA) Oscar Huang conducted an unannounced case management visit to the home today. LPA met with Licensee Ying Chen and explained the nature of today's visit to her. Licensee has requested to increase her licensed capacity to 14 children. LPA noted that licensee was licensed at 6387 Rainbow Drive, San Jose, License # 434415347 started on 11/09/2017, and closed on 09/30/2019. Licensee has been licensed at this new location as a small Family Child Care Home since March 2, 2023 at the same location. Licensee's total years of experience as a licensee is over 1 year, and is thus eligible to apply for the capacity increase. LPA observed licensee, her husband, and 3 day care children (1 preschooler and 2 infants) in the home during today's visit. Days and hours of operation are Monday - Friday from 7:00 AM to 7:00 PM. The adults that reside in the home are the Licensee and her husband.

A review of staff records on 05/25/2023 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violate

LPA observed Licensee has current CPR and First Aid certifications which are expiring 11/2024. LPA observed a current roster of the children and a fire and disaster drills log which is to be done at least once every six months. The last drills were conducted on 05/09/2023. The licensee's certification of completion of the AB1207 Mandated Reporter Training exp. on 12/27/2024.

LPA reviewed all 4 children files. Immunization records are maintained and up-to-date, LPA observed Notification of Parents’ Rights is in each child’s file, and infant sleeping 15 min. check logs for two infants under 2 years old. The facility does carry liability insurance under Markel.

Supervision of children was discussed with Licensee, and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options. Licensee states that she does not transport children via vehicle but she understands that children cannot be left in parked vehicles unattended at any time.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A fire clearance granted from the San Jose Fire Department was received on 5/23/2023: Fire Clearance Granted For 14 Total Of Capacity. Side Yard Off Limits, Garage Off Limits, Rooms Off Limits In House Marked With Red ( a bedroom & master bathroom).

Based on today's inspection, LPA advised licensee that a Large Family Child Care Home license will be approved pending on the management approval:

No deficiency was cited. A notice of site visit was given and must remain posted for 30 days. The report was discussed and verbally translated into Chinese during the exit interview with Licensee, Ying Chen.
