On 08/14/24, Licensing Program Analysts (LPAs) Janette Cruz and Jennifer Beehler met with Applicant Representative, Julie Denholm. The purpose of the visit was an unannounced prelicensing inspection at the facility to ensure that health, safety and personal rights as required by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. The facility has an existing preschool program Facility # 434415313 with a capacity of 45 preschool children which will be converted to a single license upon completion of the inspection process. Applicant is requesting to add a toddler component and be licensed for 6 toddlers (ages 18-36 months) in classrooms #4 with 39 preschoolers (ages 2-6 years) in classrooms #5 and #7. Hours of operation will be Monday to Friday 07:30 AM to 6:00PM. Fire clearance by San Jose Fire Department was granted on 07/10/24. Facility is located in a church site, Trinity Presbyterian Church.

All indoor and outdoor activity space utilized for the children was inspected today. LPAs informed Applicant that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor activities. A fully equipped first aid kit is located in all classrooms. There is an operational carbon monoxide detector on site. All required licensing documents were observed posted near the facility office.
LPAs continued to tour the facility and measured all indoor and outdoor activity space.

The Indoor total measurements contain a total of {560.61} square feet, which will accommodate Applicant’s request for 6 toddlers.

Outdoor total measurements contain a total of {1123.91} square feet, which will accommodate Applicant’s request for 6 toddlers.

Applicant was reminded that a child who is between 18 months and 36 months of age may participate in the toddler program with written permission from the child's authorized representative. No child in the toddler program shall be placed in the preschool program before the age of 30 months without written permission from the child's authorized representative.

LPAs observed all indoor activity space to be complete with safe, age-appropriate furniture and equipment. Tables and chars were observed to meet the needs of the children. There are 73 chairs, 13 tables, 60 cubbies, 36 cots, 3 toilets, 3 sinks, 1 changing table available for preschool and toddler children. There were age-appropriate toys that are safe with no sharp edges, splinters, or points, nor made of small parts that can present a choking hazard. LPAs observed all hazardous items to be inaccessible to children. When medications are on site, Applicant stated that they will be stored in kitchen space near room 4. There are no bodies of water or weapons on the property.

LPAs observed a changing table is within arm’s reach of a sink. The isolation area for children who are ill will be at the facility office. Snacks will be provided by the facility, lunch will be provided by parents.

The facility currently has a fully fenced playground and separate area for toddlers and preschool children. Fencing is at least four feet high. Shade is provided via trees and canopies. There are sufficient outdoor age-appropriate toys and play equipment available on the playgrounds. There are age-appropriate climbing structures on the toddler yard. There is adequate cushioning (tanbark and grass) in fall zones. Drinking water is available via water fountains and water bottles to be labeled for each child. LPAs observed all hazardous items on the playground(s) to be inaccessible to children. Applicant was reminded that any changes to the facility must be reported to and approved by Community Care Licensing.

Due to conversion to single license, LPAs re-evaluated preschool outdoor and indoor space.

The total square footage for all the outdoor activity space for the preschool is (1607.17), which is sufficient to accommodate the requested capacity of 39 preschool children.

The total square footage for all the indoor activity space for the preschool is (4243.51), which is sufficient to accommodate the requested capacity of 39 preschool children.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPAs discussed the safe sleep regulations with Applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPAs also informed Applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication.

The following corrections are needed before licensure will be considered.
1. Proof of photo that toddler outdoor activity space is ready and equipped with variety of age appropriate toys, sandbox with cover and equipment with ground cushioning.
2. Plan of supervision for sharing toddler bathroom with preschool children.

An exit interview was conducted and a copy of appeal rights and this report was provided to the Applicant Representative, Julie Denholm. Final license determination will be made upon review by the Licensing Program Manager.
