| Licensee has a working telephone in the home. LPA observed a fully charged fire extinguisher in the garage and a working smoke and carbon monoxide detector in the living room. LPA reminded applicant that the fire extinguisher needs to be serviced once every 12 months. LPA informed the applicant that fire/disaster drills must be practiced at least once every 6 months and documented. LPA reminded Applicant that smoking is not allowed in family childcare homes and baby walkers shall not be allowed on the premises of the family childcare home in accordance with Health and Safety Code Section 1596.846(b) and (c).
Applicant states that she will provide lunch and snacks for the day care children. LPA reminded applicant that any food/liquid products provided by parents will need to be labeled with each child's individual name(s). Drinking water will be provided to children via individual water bottles and refilled using store bought water.
LPA reviewed the two children's files. Applicant does not have liability insurance for the day care and issues the Affidavit Regarding Liability Insurance for Family Child Care Home (LIC 282).
LPA discussed the requirement for Licensee to be present at the facility 80 percent of the hours the facility is in operation and that temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. Applicant understands the capacity options and understands that she cannot have more than 12 children in the home at any time and a qualified assistant must be present. Applicant understands in absence of a helper her license capacity is reduced to 8 and ratio (age of the children) must be observed.
Licensee/Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
Licensee stated that the form of discipline will be to sit at the table. LPA informed the applicant that time out can only be used one minute per year of age. Applicant understands that children's personal rights should not be violated; including no corporal punishment. Children have personal rights that cannot be waived or abridged regardless of consent or authorization from the child’s authorized representative.
LPA discussed "zero tolerance" related regulations which includes the assessment of an immediate $500 per day civil penalty for any violation of a "zero tolerance" related regulation. A $500 immediate civil penalty is assessed for serious violations such as absence of supervision, accessible bodies of water, accessible firearms, refused entry of licensing staff, presence of an excluded person, and violations that result in illness or injury. An ongoing civil penalty of $100 per day continues until the violation(s) is corrected.
