Licensing Program Analyst (LPA) Farida Raja conducted an announced, scheduled Relocation/Pre-Licensing inspection in response to Licensee/Applicant, Linda Garcia request of change location for her Large Family Child Care Home. Applicant/ Licensee’s previous facility number is #434409366. LPA explained the nature of today’s inspection to Licensee/Applicant. Per Applicant, the adults that reside in the home are applicant and mother and both have valid fingerprint and tuberculosis clearances. No minor children reside in the home. A fire clearance from San Jose Fire department was granted on 04/30/2025. Present during the inspection were two children including one infant and one preschool child. LPA reminded Applicant that she is only exempt for licensure if she is providing care to children of only one family in addition to the operator's own children or children related to her. Applicant stated that the infant child (C1) is related to her.

Days and hours of operation will be Monday - Friday from 6:00 AM to 6:00 PM and will serve children ages 6 weeks - 13 years old. Applicant stated that she occasionally provides overnight care. LPA advised Applicant to submit an updated LIC 279 to include the overnight care hours. Applicant has completed her Preventative Health and Safety Child Care Training on 02/27/2025 and a copy of the certification is on file. Applicant's CPR and First Aid certifications are current and expire on 04/12/2027. Applicant has completed the Mandated Reporter Training for Child Care Workers on 03/14/2025. A copy of current MMR, Tdap and statement declining influenza immunization for the Applicant are on file. LPA reminded Applicant that to provide overnight care the provider shall remain awake whenever children are awake, the door to the room where the provider is sleeping as well as the door to the room where the children in care are sleeping shall remain open and if provider is unable to hear the children wake up then a digital video and audio monitoring device shall be used.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Applicant rents the home and provided a copy of the current lease agreement as proof of control of property. Applicant provided the Property Owner/Landlord Notification form (LIC9151) that she confirms was provided to the property owner/landlord. Applicant has not obtained a signed Property Owner/Landlord Consent form (LIC 9149). Without this consent applicant can provide care to a maximum of 12 children. LPA discussed ratio and ages of children and provided Applicant with a copy of the regulations and a ratio chart.

LPA inspected home for any health and safety hazards. Toys and equipment for the day care children were observed to be age appropriate. Areas accessible to children were inspected to ensure that they are clean and orderly. Off limit areas indoors include master bedroom, master bathroom, one bedroom and attached garage. Cleaning products, toxic agents, medications, and sharp objects were inaccessible to children. Cleaning products were observed to be stored in the garage. Knives and sharp items were moved to high cabinets during today's inspection. First aid kit is stored in the hallway closet next to the bathroom. Applicant moved cleaning products and medications to a high shelf in the closet during today's inspection. The home has heating, air conditioning and ventilation for comfort of children. Bathroom used by children was in operating condition. Toilets and faucet are clean and operable. Shower area is free of hazards. LPA reminded Applicant that toothpaste, shampoos, air fresheners, razors, mouthwash, perfumes and similar items need to be placed inaccessible to children in care. Applicant states that children will nap in the bedroom and LPA observed one crib and two beds for children to nap on. LPA advised Applicant that children should not be left for extended periods of time in furniture such as a high chairs or cribs.

The home has no fireplace or wall heaters. LPA reminded Applicant that poisons need to be locked. Applicant states that she does not have any weapons. Applicant does not have any pets. LPA reminded Applicant that wading pools and other bodies of water need to be emptied after each use. The Department has a zero tolerance policy on accessible bodies of water.



LPA inspected the outdoor area and observed it to be fenced. Off limit areas outdoors include locked shed. There are no bodies of water observed. Shade is provided outdoors by pergola and trees. LPA observed some exposed nails and metal wire and an area behind the locked shed that a child can hide behind. LPA advised applicant to make all exposed nails inaccessible to children and area behind shed off limits to children. LPA advised applicant to inspect outdoor area for any hazards prior to allowing access to children and supervise children while they participate in outdoor activities.

Licensee has a working telephone in the home. LPA observed a fully charged fire extinguisher in the garage and a working smoke and carbon monoxide detector in the living room. LPA reminded applicant that the fire extinguisher needs to be serviced once every 12 months. LPA informed the applicant that fire/disaster drills must be practiced at least once every 6 months and documented. LPA reminded Applicant that smoking is not allowed in family childcare homes and baby walkers shall not be allowed on the premises of the family childcare home in accordance with Health and Safety Code Section 1596.846(b) and (c).

Applicant states that she will provide lunch and snacks for the day care children. LPA reminded applicant that any food/liquid products provided by parents will need to be labeled with each child's individual name(s). Drinking water will be provided to children via individual water bottles and refilled using store bought water.

LPA reviewed the two children's files. Applicant does not have liability insurance for the day care and issues the Affidavit Regarding Liability Insurance for Family Child Care Home (LIC 282).

LPA discussed the requirement for Licensee to be present at the facility 80 percent of the hours the facility is in operation and that temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. Applicant understands the capacity options and understands that she cannot have more than 12 children in the home at any time and a qualified assistant must be present. Applicant understands in absence of a helper her license capacity is reduced to 8 and ratio (age of the children) must be observed.

Licensee/Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Licensee stated that the form of discipline will be to sit at the table. LPA informed the applicant that time out can only be used one minute per year of age. Applicant understands that children's personal rights should not be violated; including no corporal punishment. Children have personal rights that cannot be waived or abridged regardless of consent or authorization from the child’s authorized representative.

LPA discussed "zero tolerance" related regulations which includes the assessment of an immediate $500 per day civil penalty for any violation of a "zero tolerance" related regulation. A $500 immediate civil penalty is assessed for serious violations such as absence of supervision, accessible bodies of water, accessible firearms, refused entry of licensing staff, presence of an excluded person, and violations that result in illness or injury. An ongoing civil penalty of $100 per day continues until the violation(s) is corrected.

LPA observed postings near the entrance and reminded applicant about all forms that are required to be posted. LPA reviewed with licensee/Applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the licensee. LPA also discussed with licensee/Applicant procedures for Reporting Suspected Child Abuse and Unusual Incidents/Injuries.

Licensees states that she will provide transportation to children. LPA reminded Licensee that children cannot be left in parked vehicles unattended at any time, the motor vehicles used to transport children shall be maintained in safe operating conditions, and all vehicle occupants must be secured in an appropriate restraint system.

LPA discussed the safe sleep regulations with licensee/Applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA provided Applicant with a a copy of the individual infant sleep plan (LIC 9227) and a sample 15 minute nap check log. LPA reminded licensee that if an infant is sleeping in a separate room from where the provider is stationed the door to the room the infant is sleeping in shall remain open at all times. The provider shall be able to visually observe the infant without moving the door.

On this date 05/19/2025, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with the Applicant, Linda Garcia. LPA advised Applicant that a Large Family Child Care Home license with a maximum capacity of 12 children will be granted upon submission of the below items and manager review and approval.

1. Updated facility Sketch (LIC 999A) indicating areas on and off limit to children, electric, gas and water shut off locations and yard size.

2. Application for a Family Child Home License (LIC 279) showing updated hours.

3. Picture proof of exposed nails, metal wire and area behind shed made inaccessible. Picture proof of air conditioning condenser made inaccessible.
