Licensing Program Analysts (LPAs) Marilou Monico and Elizabeth Berumen met with Applicant Representative/Executive Director, Julie Kennedy, and Assistant Director, Shelly Frost, for the purpose of conducting a pre-licensing inspection in response to a request for change of location and change of capacity. LPAs note that the facility is licensed at 1670 Moorpark Avenue, San Jose, CA 95128 (Facility number: 434408853).

The Infant Program will operate Monday through Friday from 7:30 AM to 5:30 PM, serving children ages 6 weeks to 2 years old. The infant program is located in Building A and will be utilizing Infant Rooms 1 thru 3.

LPAs toured and measured the indoor and outdoor areas of the facility during today's inspection.

Indoor Activity Space:

INFANT 1: 26.000 x 22.333 = 580.658 minus 25.166 (encumbered space) = 555.492
INFANT 2: 29.917 x 21.667 = 648.211 minus 28.803 (encumbered space) = 619.408
INFANT 3: 1/2 (12.417 x 33.000) = 204.880
38.000 x 11.333 = 430.654
INFANT 3 TOTAL = 635.534 minus 33.666 (encumbered space) = 601.868
TOTAL INDOOR SPACE = 1,776.768 sq. ft. divided by 35 = 50 children

The infant program has 2 sinks (30) available for the children. The sinks only have cold running water. There are staff bathrooms labeled as "Ladies" and "Men" located in the Multi-purpose Room. The sick children will be using the "Ladies" staff bathroom if needed and will be accompanied by a staff member. Sick children will be isolated in the Director's Office/My School Office (Room 105) and isolation equipment will be provided. The staff bathrooms are clean, sanitary, and operable.

There are 6 chairs, 2 tables, 48 cubbies, and 3 cribs for the children. LPAs observed a diaper changing area in between Infant 1 and 2 with two diaper changing tables within arm's reach of a sink. There are trash cans with tight fitting lids for the disposal of diapers. LPAs observed containers with tight-fitting covers for the disposal of solid waste in each room. There is a crib area located in Infant 3 that has at least four feet partition in between the crib area and children's activity area. First aid supplies are stored in the classrooms and in the Director's Office inaccessible to children. Cleaning supplies are stored in the upper cabinet in the Director's Office. LPAs observed smoke/carbon monoxide detectors and adequate lighting in each classroom. The facility has central heating and air conditioning. Medications will be stored in a locked cabinet in the Director's Office.

Julie & Shelly understand that the facility must be kept free of flies, other insects & rodents. Additional furniture, equipment, and supplies will be moved to this location from the Moorpark site once licensed. Drinking water will be readily available for the children indoors via individual water bottles. Transportation will not be provided by the facility.

Parents are responsible to bring lunch and snacks for their children. There is an off-limits kitchen located in Multi-purpose Room in Building B to warm children's food and bottles, and additional space to store children's food. The kitchen is clean and equipped with hot and cold running water, refrigerators, microwave, stove, oven, dishwasher, and storage space for food. Disposable utensils and plates will be utilized by the facility.

LPAs observed that the playground is fully fenced which meets the height requirements. Shades are provided by trees, and building overhang. The areas under and around the play structures are cushioned with material (sand) that will absorb a fall. Drinking water will be provided via individual water bottles. No bodies of water were observed.

This facility plans to provide Incidental Medical Services – IMS. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. A Plan of Operation that includes IMS was submitted to the Department. Julie and Shelly were reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPAs reviewed with Julie and Shelly the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Fire clearance was granted on January 19, 2023.

Exit interview conducted and report was reviewed with Julie Kennedy, Applicant Representative/Executive Director. LPAs advised Julie that a license for 15 children in the Infant Program will be submitted to Licensing Management for the final stage of approval.
