Licensing Program Analyst (LPA) Deanna Villagrana met with licensee Ana Aguilar for an announced change of location visit. Licensee is currently licensed at 1018 Montebello Dr. Gilroy, Ca 95020 (434413454). Present were licensee and licensee's husband. Days and hours of operation are Monday to Sunday, 5:00am to 10:00pm. The adults that reside in the home are licensee, husband with her 13 year old daughter and 10 year old son.

A review of staff records on 09/13/2024 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee Ana Aguilar was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.


LPA toured the indoor and outdoor areas of the home during today’s inspection. LPA observed that the home is clean and orderly, with heating and ventilation for safety and comfort of the children. LPA observed a barricaded fireplace in the home. LPA observed stair were not barricaded. LPA observed safe and sufficient materials, toys, and play equipment for the day care children. All sharp objects, detergents, cleaning compounds, medications, poisons, and other similar items inside the home are stored inaccessible to children. LPA observed a fully charged 3A40BC fire extinguisher a working smoke and carbon monoxide detector. Licensee states there are no weapons/firearms or pets in the home. Off limit areas indoor: upstairs master bedroom/bath, one bedroom, and attached garage. There are no bodies of water. Off limits outdoors: left side of the home fenced off to children and locked storage. LPA observed licensee has a current CPR and First Aid certification expiring 03/03/2026 and completed Mandated Reporter training on 8/4/2023.

LPA reviewed with Ana Aguilar the LIC 311D, Forms/Records To Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Forms of discipline used by Applicant: talking to children and redirection. Applicant understands that children's personal rights should not be violated; including no corporal punishment. Isolation of sick children, supervision of children, capacity options, transportation of children, requirements for reporting suspected child abuse, unusual incidents/injuries, heat related illnesses, and requirements for assistant/substitute were also discussed. LPA informed Applicant that fire/disaster drills must be practiced at least once every six months and documented.


LPA discussed the safe sleep regulations with Ana Aguilar and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Ana Aguilar of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.


LPA discussed the requirements of AB 633 with the Applicant and provided her the AB 633 fact sheet and a copy of Acknowledgement of Receipt of Licensing Reports (LIC 9224) and Applicant understands the requirements. LPA also discussed "zero tolerance" related regulations with the Applicant and advised her of the assessment of an immediate $500 civil penalty for any violation of a "zero tolerance" related regulation. An ongoing civil penalty of $100 per day continues until the violation(s) is corrected. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. SB 792 Immunization Requirements was also discussed. Applicant's immunization records are on file.

Exit interview conducted and report was reviewed with the Ana Aguilar. Licensee was informed change of location is approved pending a photo of barricaded stairs and an updated Plan of Emergency (LIC610A). Once the Department receives, licensee will be pending Manager's approval.
