| Based on the LPA’s conducted room observations, interviews and reviewed facility records, as follows.
1. Staff 3 (S3) is a Teacher Aide and were supervising children in care, on today’s LPA’s visit, without direct supervision of a teacher. At 10 am, Staff 1 (S1) supervised 8 toddlers with Staff 2 (S2), S2 is not a qualified teacher aide.
When this happened, the group and or the classroom becomes out of ratio because the section stated, Teacher-Child Ratio - 101216.3 (b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. An aide who is participating in on-the-job training may be substituted for a teacher when directly supervised by a fully qualified teacher......
2. S1 stated that the outdoor play area gate was left open, approximately at noon. S1 stated that S1 could not remember the date when it happened. S3 stated that on 7/1/2026 during an outdoor activity in the morning, she came to learn that the outdoor play area gate was left open by Staff 4 (S4). Outdoor Activity Space 101238.2 (g) The playground shall be enclosed by a fence to protect children and to keep them in the outdoor activity area.
The preponderance of evidence standard has been met; therefore, the above allegation is to be SUBSTANTIATED.
