Licensing Program Analyst (LPA), Cortney Nelson, met with Education Manager, Lorena Gonzalez, and Site Supervisor, Cecilia Esquivel, to follow-up on Unusual Incident Reported on 4/25/2022 regarding child who was sprayed with diluted cleaning solution.

Upon arrival, LPA was admitted into the facility by teacher, Edgar Sanchez, and Family Services Advocate (FSA), Jessica Ruiz. LPA explained purpose of visit to Edgar and Jessica. Shortly before 2:00PM, Cecilia Esquivel, Site Supervisor, arrived at the facility and let LPA know that Lorena Gonzalez, Education Manager, was on her way with the staff files and would arrive soon.

Present at the facility were 6 staff members and 28 children, 3 staff and 14 children per room. LPA conducted staff interview, reviewed staff files, and inspected indoors and outdoors of Room 1 during todays visit.

Additional purpose of visit is to cite for failure to report for temporary closures of facility, positive COVID cases, and changes in Site Director following Title 22 California Code of Regulation timeline requirements. On 1/25/2022 message was left for San Jose Regional Office regarding temporary closures and COVID cases at Encompass Family Services sites. No additional follow-up or reports were made in February, March, or April 2022.

Lorena additionally states that former Site Director, Concepcion Morales, ended her employment 2/2021 and new Site Director, Leslie Garibay, started 12/2021. Licensing was not notified of the change in director at the facility and qualifications were not reviewed prior to Site Director employment.

This requirement was not met as evidenced by: Licensee did not follow reporting requirements for communicable diseases (COVID), temporary closures, and change in Site Director, which poses a potential risk to the health, safety, and personal rights of the children in care.

This requirement was not met as evidenced by: cleaning solution bottle was left outside accessible to children and one child was sprayed with diluted bleach solution.

Licensee removed cleaning solution that was accessible to children and placed back into inaccessible location. Documentation of how cleaning products will be kept inaccesible to children in the future to be submitted to Department by 5/13/2022.

LPA discussed reporting requirements with Lorena and Cecilia in addition to the roles of each position at Encompass Family Services. LPA shared requirements of Site Director and Administrator for Title 22 Regulations. If the job responsibilities of "Teacher-Director" do not meet the requirements for a Site Director (per regulations), there will need to be follow-up on how those requirements will be met. Regulations provided and discussed: 101215.1 Child Care Center Directors Qualifications and Duties, 101215 Administrator Qualifications and Duties. LPA requested that Lorena submit job responsibilities/duties for Site Supervisor and Teacher-Director at Encompass.

Exit interview conducted and report was reviewed with Education Manager, Lorena Gonzalez and Site Supervisor, Cecilia Esquivel

As a result of today’s inspection, deficiencies were cited see 809-D.

A NOTICE OF SITE VISIT WAS GIVEN AND MUST REMAIN POSTED FOR 30 DAYS.
