Licensing Program Manager (LPM), Joel Segura, and Licensing Program Analyst (LPA), Marilou Monico, met with Executive Director, Heidi Lister, and Preschool Site Director, Tina Burcher, at the San Jose Regional Office today for a scheduled Informal Meeting. The purpose of today's meeting is to discuss the Licensee's compliance and ability to follow the Title 22 Regulations.

This Informal Meeting is a result of the following citations:
10/16/24 - Section 101229(a)(1) - Responsibility for Providing Care & Supervision - A daycare child, C1, exited the playground unnoticed by staff and had gone out the gate. This poses an immediate risk to the health, safety, and personal rights of children in care. Since this is a repeat violation within a 12 months, $1000 civil penalty was assessed.
11/21/23 - Section 101229(a)(1) - Responsibility for Providing Care & Supervision - The Licensee did not ensure that children are visually supervised at all times as a child was left outside during a transition to inside, which poses an immediate risk to the health, safety, and personal rights of children in care. $500 civil penalty was assessed.

The facility implemented the following plan to bring the facility in compliance:
1) Frequent headcounts and confirming headcount with other staff in the classroom or yard
2) Station a staff member next to the gate. Use the smaller yard if no staff available to stay near the gate.
3) Staff training on supervision of children was conducted on October 22, 2024

Executive Director and Preschool Site Director agreed to increase supervision. Executive Director and Preschool Site Director agreed to provide ongoing staff training on care and supervision, head counting, and positioning of staff. Training agenda and proof of attendance shall be maintained at facility for Community Care Licensing review. Executive Director and Preschool Site Director agreed to conduct daily monitoring to assure staff are properly positioned and providing adequate supervision.

LPM explained to Executive Director and Preschool Site Director that if there are continued deficiencies cited for the issues noted on this report, the Facility may be referred to legal department for possible administrative action, which could include revocation of the Facility license. The Facility will be monitored for the next 12 months at the department's discretion to ensure that the Facility is in compliance with the Department regulations.

Assembly Bill 633 (Child Care Parent Notification Requirements) and Acknowledgement of Receipt of Licensing Report (LIC9224) was also explained and provided to Executive Director and Preschool Site Director during today’s meeting.
